The question of the use of the statements in criminal proceedings did not arise, as his refusal to make a statement was not used as evidence: it constituted the offence itself (see Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII).The Court noted that there were no pending or anticipated criminal proceedings against the applicant and the fact that he may have lied in order to prevent the revenue authorities from uncovering conduct which might possibly lead to a prosecution did not suffice to bring the privilege against self-incrimination into play (see Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII).

The Court noted that there were no pending or anticipated criminal proceedings against the applicant and the fact that he may have lied in order to prevent the revenue authorities from uncovering conduct which might possibly lead to a prosecution did not suffice to bring the privilege against self-incrimination into play (see Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII). - EGMR, 05.04.2012 - 11663/04

MARTTINEN v. FINLAND
The mere fact that the applicant failed to arrive at the Bailiff's office, thus not replying to any possible questions - whether or not allegedly having any relevance to the present examination - motivated the administrative fine (see Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII). - EGMR, 04.10.2022 - 58342/15
DE LEGÉ v. THE NETHERLANDS
Article 6 of the European Convention on Human Rights (ECHR) does not preclude this (see [Allen v. the United Kingdom (dec.), no. 76574/01, 10 September 2002] and [Marttinen v. Finland, no. 19235/03, § 68, 21 April 2009]).In Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII, the Court held that the requirement on the applicant to make a declaration of his assets to the revenue service did not disclose any issue under Article 6 even though a separate penalty was attached to a failure to do so.

LUCKHOF and SPANNER v. AUSTRIA
The question of the use of the statements in criminal proceedings did not arise, as his refusal to make a statement was not used as evidence: it constituted the offence itself (see Allen v. the United Kingdom (dec.), no. 76574/01, ECHR 2002-VIII). - EGMR, 15.09.2020 - 10487/16
SAVIC v. AUSTRIA
The fact that he may have lied in order to prevent the revenue authorities from uncovering conduct which might possibly lead to a prosecution did not suffice to bring the privilege against self-incrimination into play (see Allen v. the United Kingdom (dec.), no. 76574/01, § 1, ECHR 2002-VIII). - EGMR, 23.03.2006 - 38258/03
VAN VONDEL v. THE NETHERLANDS
- EGMR, 08.12.2015 - 56936/13
EKLUND v. FINLAND
In this respect, the applicant's case is similar to the cases of Allen v. the United Kingdom (dec.) (no. 76574/01, ECHR 2002-VIII) and Elomaa v. Finland (dec.), no. 37670/04, 16 March 2010, where the Court found that the applicant's subsequent conviction for the offence of making a false declaration of his assets to the tax authority was not an example of forced self-incrimination, but the result of the offence itself. - EGMR, 16.03.2010 - 37670/04
