In this connection, the Court points out that in order to determine whether the applicant's rights under Articles 9 and 10 of the Convention were breached it must first be ascertained whether the conviction in question amounted to an interference with the exercise of those rights by the applicant (see the Kosiek v. The admissibility of evidence is primarily a matter for regulation by national law and, as a rule, it is for the national courts to assess the evidence before them (see the Kostovski v. the Netherlands judgment of 20 November 1989, Series A no. 166, p. 19, § 39).
