VALASINAS v. LITHUANIA
Auszug aus EGMR, 12.03.2015 - 31305/09
Thus in the case of Valasinas v. Lithuania (no. 44558/98, § 117, ECHR 2001-VIII), in which the applicant, a male prisoner, was stripped naked in the presence of a female prison officer ‒ who in the course of searching him touched his sexual organs and his food with her bare hands ‒ the Court found a breach of Article 3. In the case of Wiktorko v. Poland (no. 14612/02, §§ 54-55, 31 March 2009), the Court held that the forcible undressing of a female applicant by a male personnel at a de-intoxification centre and her subsequent lashing to a bed with belts for about ten hours constituted degrading treatment within the meaning of Article 3 of the Convention. - EGMR, 20.06.2013 - 63638/09
TURLUYEVA v. RUSSIA
Auszug aus EGMR, 12.03.2015 - 31305/09
Thus, the mere fact that appropriate steps were not taken to reduce the risk of collusion between alleged perpetrators amounts to a significant shortcoming in the adequacy of the investigation (see, mutatis mutandis, Ramsahai and Others v. the Netherlands [GC], no. 52391/99, § 330, ECHR 2007-II, and Turluyeva v. Russia, no. 63638/09, § 107, 20 June 2013). - EGMR, 06.04.2000 - 26772/95
LABITA c. ITALIE
Auszug aus EGMR, 12.03.2015 - 31305/09
It prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the circumstances and the victim's behaviour (see, for example, Labita v. Italy [GC], no. 26772/95, § 119, ECHR 2000-IV).

IWÁNCZUK v. POLAND
Auszug aus EGMR, 12.03.2015 - 31305/09
In the case of Iwanczuk v. Poland (25196/94, §§ 54-60, 15 November 2001), the Court held that while strip searches might be necessary on occasions to ensure prison security or prevent disorder in prisons, they had to be conducted in an appropriate manner. - EGMR - 43441/08 (anhängig)

The public nature of the treatment may be a relevant or aggravating factor in assessing whether it is "degrading" within the meaning of Article 3 (see Svinarenko and Slyadnev v. Russia [GC], nos. 32541/08 and 43441/08, § 115, ECHR 2014 (extracts)). - EGMR, 03.07.2008 - 7188/03
CHEMBER v. RUSSIA
Auszug aus EGMR, 12.03.2015 - 31305/09
However, many acts that would constitute degrading or inhuman treatment in respect of prisoners may not reach the threshold of ill-treatment when they occur in the armed forces, provided that they contribute to the specific mission of the armed forces in that they form part of, for example, training for battlefield conditions (see Chember v. Russia, no. 7188/03, § 49, ECHR 2008). - EGMR, 26.10.2000 - 30210/96
Das Recht auf Verfahrensbeschleunigung gemäß Art. 6 Abs. 1 S. 1 EMRK in …
Auszug aus EGMR, 12.03.2015 - 31305/09
The Court has consistently stressed that the suffering and humiliation involved must in any event go beyond that inevitable element of suffering or humiliation connected with a given form of legitimate treatment or punishment (see Kudla v. Poland [GC], no. 30210/96, §§ 92-94, ECHR 2000-XI). - EGMR, 05.11.2013 - 36716/07
MESUT DENIZ v. TURKEY
Auszug aus EGMR, 12.03.2015 - 31305/09
Furthermore, the investigation must be independent, impartial and subject to public scrutiny (see Mesut Deniz v. Turkey, no. 36716/07, § 52, 5 November 2013).

Lituanie, no 44558/98, CEDH 2001-VIII, Iwanczuk c. Pologne, no 25196/94, 15 novembre 2001, Yankov c. Bulgarie, no 39084/97, § 110, CEDH 2003-XII (extraits), et Lyalyakin c. MIHHAILOV v. ESTONIA
The mere fact that appropriate steps were not taken to reduce the risk of collusion between alleged perpetrators amounts to a significant shortcoming in the adequacy of the investigation (see, mutatis mutandis, Ramsahai and Others v. the Netherlands [GC], no. 52391/99, § 330, ECHR 2007-II; mutatis mutandis, Jaloud v. the Netherlands [GC], no. 47708/08, § 208, ECHR 2014; and Lyalyakin v. Russia, no. 31305/09, § 84, 12 March 2015).
