47. The need to protect the essence of the right to marry was the major concern in the judgment of B. and L. v. the United Kingdom, no. 36536/02, 13 September 2005, concerning the prohibition on marriage between a fatherinlaw and his daughterinlaw.

The resulting judgment of the domestic court is necessarily binding on the parties to the proceedings (see, by contrast, Burden, §§ 40 and 43, cited above, and B. and L. v. the United Kingdom (dec.), no. 36536/02, 29 June 2004).Such an approach, in turn, would defeat the object and purpose underlying the Convention that rights and freedoms should be secured by the Contracting State within its jurisdiction and undermine the subsidiary nature of the Court's own role and capacity to function (see B. and L. v. the United Kingdom (dec.), no. 36536/02, 29 June 2004, and Burden v. the United Kingdom [GC], no. 13378/05, § 42, ECHR 2008).
