    F. v. SWITZERLAND

    Auszug aus EGMR, 13.09.2005 - 36536/02
It is subject to the national laws of the Contracting States but the limitations thereby introduced must not restrict or reduce the right in such a way or to such an extent that the very essence of the right is impaired (see Rees v. the United Kingdom, judgment of 17 October 1986, Series A no. 106, § 50; F. v. of the Contracting States but the limitations thereby introduced must not restrict or reduce the right to marry in such a way or to such an extent that the very essence of the right to marry is impaired (see Rees v. United Kingdom, 17 October 1986, § 50, Series A no. 106; F. v. Switzerland, 18 December 1987, § 32, Series A no. 128; and B. and L. v. United Kingdom, no. 36536/02, § 34, 13 September 2005).

The exercise of the right to marry is subject to the laws of the Contracting States, but any limitations thereby introduced must not restrict or reduce the right to marry in such a way or to such an extent that the very essence of the right to marry is impaired (see Rees v. the United Kingdom, 17 October 1986, § 50, Series A no. 106; F. v. Switzerland, 18 December 1987, § 32, Series A no. 128; and B. and L. v. the United Kingdom, no. 36536/02, § 34, 13 September 2005).

    47. The need to protect the essence of the right to marry was the major concern in the judgment of B. and L. v. the United Kingdom, no. 36536/02, 13 September 2005, concerning the prohibition on marriage between a fatherinlaw and his daughterinlaw.

Asylbewerber monatelang festgehalten: Polen muss 12.000 Euro Entschädigung zahlen

The resulting judgment of the domestic court is necessarily binding on the parties to the proceedings (see, by contrast, Burden, §§ 40 and 43, cited above, and B. and L. v. the United Kingdom (dec.), no. 36536/02, 29 June 2004).

Such an approach, in turn, would defeat the object and purpose underlying the Convention that rights and freedoms should be secured by the Contracting State within its jurisdiction and undermine the subsidiary nature of the Court's own role and capacity to function (see B. and L. v. the United Kingdom (dec.), no. 36536/02, 29 June 2004, and Burden v. the United Kingdom [GC], no. 13378/05, § 42, ECHR 2008).

    KOROSIDOU c. GRECE

Royaume-Uni (déc.), no 36536/02, 29 juin 2004, § 34).

    THEODOROU ET TSOTSOROU c.

  • EGMR, 11.04.2006 - 29800/04

    UPTON v. THE UNITED KINGDOM

Article 35 § 1 also requires that the complaints intended to be brought subsequently before the Court should have been made to the appropriate domestic body, at least in substance and in compliance with the formal requirements laid down in domestic law, but not that recourse should be had to remedies which are inadequate or ineffective (e.g. Akdivar and Others v. Turkey, no. 21893/93, §§ 65-67, ECHR 1996-IV; Aksoy v. Turkey, no. 21987/93, §§ 51-52, ECHR 1996-VI; B and L v. the United Kingdom, no. 36536/02 (dec.), 29 June 2004).
