    Moreover, the Court recalls that, had evidence emerged at any time during the investigation that the negligence of any person had caused the Trident to founder, it would also have been open to the applicants to commence civil proceedings for damages, without waiting for the sheriff's conclusions (see, mutatis mutandis, Rajkowska v.
