La Cour note aussi que la Cour suprême n'a pas procédé à une évaluation des éléments de preuve qui avaient été versés au dossier de l'enquête pénale (comparer avec Kaiser c. Autriche (déc.), no 15706/08, § 51, 13 décembre 2016) et qu'elle s'est uniquement penchée sur le motif de classement sans suite afin de fonder ses décisions.
