  The Court does not exclude that an issue might exceptionally be raised under Article 6 by an expulsion decision in circumstances where the person being expelled has suffered or risks suffering a flagrant denial of a fair trial in the receiving country, particularly where there is the risk of execution (see, mutatis mutandis, Soering v. the United Kingdom, judgment of 7 July 1989, Series A no. 161, p. 45, § 113; Ocalan v. Turkey, no. 46221/99, judgment of 12 March 2003, §§ 199-213).

  The Court also attaches importance to the fact that the case concerns expulsion to another High Contracting Party to the Convention, which has undertaken to secure the fundamental rights guaranteed under its provisions (see Tomic v. the United Kingdom, (dec.), no. 17837/03, 14 October 2003; and Hukic v. Sweden (dec.), no. 17416/05, 27 September 2005), and although accepting that the general living conditions in Serbia of internally displaced persons may be far from ideal (see paragraph 58-60 above), the Court cannot find that these conditions must be regarded as being so harrowing that they must be considered as having attained the minimum level of severity required for treatment to fall within the scope of Article 3 of the Convention (see Said v. the Netherlands, no. 2345/02, § 47, ECHR 2005-...).
