Das im Berufungsurteil hervorgehobene Urteil des Europäischen Gerichtshofs für Menschenrechte vom 14. Zum Informationsinteresse der Presse - auch über an einem Gerichtsverfahren …
Bei Abwägung aller Umstände ist die Namensnennung zulässig, wenn eine fundierte Berichterstattung durch die Presse kaum möglich ist, ohne die Namen aller Beteiligten zu nennen oder wenn die Offenlegung der Identität einen direkten Bezug zu der öffentlichen Angelegenheit hat, die Gegenstand der Berichterstattung ist; sie ist jedoch unzulässig, wenn die Veröffentlichung des Namens des Betroffenen den Informationen in der Veröffentlichung nichts hinzufügt und für das Verständnis der Besonderheiten des Falls nicht wesentlich ist (vgl. That approach distinguishes the present case from the Austrian one in which the Court found an interference with the right to freedom of expression to be justified because an Austrian news magazine published the full name of the police officer concerned at an early stage of criminal proceedings against him, although the disclosure of his full name did not add anything of public interest to the information already given in the article (see Wirtschafts-Trend Zeitschriften-Verlag GmbH v. Austria (no. 2) (dec.), no. 62746/00, 14 November 2002).
