PAPON v. FRANCE (No. 1)

France [GC], no 25803/94, § 101, CEDH 1999-V). - EGMR, 26.10.2000 - 30210/96

- EGMR, 19.04.2001 - 28524/95

Fixierung in psychiatrischer Unterbringung: Richtervorbehalt erforderlich?
EGMR , Labita v. Italy, Urteil vom 6. April 2000, Nr. 26772/95, § 120; EGMR , Kudla v. Poland, Urteil vom 26. Oktober 2000, Nr. 30210/96, § 92; EGMR, Keenan v. The United Kingdom, Urteil vom 3. KAFKARIS c. CHYPRE
France, no 67263/01, arrêt du 14 novembre 2002, § 48, CEDH 2002-IX).
- EGMR, 12.07.2007 - 20877/04
TESTA v. CROATIA
In exceptional cases, where the state of a detainee's health is absolutely incompatible with the detention, Article 3 may require the release of such person under certain conditions (see Papon v. France (no. 1) (dec.), no. 64666/01, CEDH 2001-VI, and Priebke v. Italy (dec.), no. 48799/99, 5 April 2001) There are three particular elements to be considered in relation to the compatibility of the applicant's health with her stay in detention: (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant (see Mouisel v. France, no. 67263/01, §§ 40-42, ECHR 2002-IX). - EGMR, 13.05.2008 - 52515/99
JUHNKE v. TURKEY
The assessment of this minimum level is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among other authorities, Mouisel v. France, no. 67263/01, § 37, ECHR 2002-IX, and Gennadi Naoumenko v. Ukraine, no. 42023/98, § 108, 10 February 2004). - EGMR, 22.12.2008 - 46468/06
ALEKSANYAN v. RUSSIA
Thus, in Mouisel v. France, no. 67263/01, §§ 40-42, ECHR 2002-IX) the Court examined such elements of the case as (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant.Furthermore, in view of the applicant's state of health and his previous conduct, the Court considers that the security risks he might have presented at that time, if any, were negligible compared to the health risks he faced (see Mouisel v. France, no. 67263/01, §§ 47, ECHR 2002-IX).

Finnland, 16. Dezember 1997, Rdnr. 56, ECHR 1997-VIII; Mouisel./. Frankreich, Individualbeschwerde Nr. 67263/01, Rdnr. 47, ECHR 2002-IX;… und Kashavelov./. Bulgarien, Individualbeschwerde Nr. 891/05, Rdnr. 38, 20. ARUTYUNYAN v. RUSSIA
In accordance with the Court's settled case-law, ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this minimum is relative; it depends on all the circumstances of the case, such as the duration of the treatment, its physical and mental effects and, in some cases, the sex, age and state of health of the victim (see, among other authorities, Price v. the United Kingdom, no. 33394/96, § 24, ECHR 2001-VII; Mouisel v. France, no. 67263/01, § 37, ECHR 2002-IX; and Naumenko v. Ukraine, no. 42023/98, § 108, 10 February 2004).Thus, in Mouisel v. France (no. 67263/01, §§ 40-42, ECHR 2002-IX) the Court examined such elements of the case as (a) the medical condition of the prisoner, (b) the adequacy of the medical assistance and care provided in detention and (c) the advisability of maintaining the detention measure in view of the state of health of the applicant.

VLADIMIR ROMANOV v. RUSSIA
In the context of detainees, the Court has emphasised that persons in custody are in a vulnerable position and that the authorities are under a duty to protect their physical well-being (see Tarariyeva v. Russia, no. 4353/03, § 73, ECHR 2006-... (extracts); Sarban v. Moldova, no. 3456/05, § 77, 4 October 2005; and Mouisel v. France, no. 67263/01, § 40, ECHR 2002-IX). - EGMR, 17.09.2009 - 74912/01
ENEA c. ITALIE
Royaume-Uni, no 33394/96, § 24, CEDH 2001-VII, Mouisel c. France, no 67263/01, § 37, CEDH 2002-IX, et Gennadi Naoumenko c. Ukraine, no 42023/98, § 108, 10 février 2004). - EGMR, 17.12.2009 - 32704/04
