The Government refer to the Court's case law in similar cases (Artico v. Italy, judgment of 13 May 1980, Series A no. 37, § 18; Daud v. Portugal, judgment of 21 April 1998, Reports of Judgments and Decisions 1998-II, § 33).The Government further recall the Court's case law to the effect that a State cannot be held responsible for every shortcoming on the part of a lawyer appointed for legal aid purposes (Artico v. Italy, judgment of 13 May 1980, Series A no. 37, § 36).

It follows from the independence of the legal profession from the State that the conduct of defence is essentially a matter between the defendant and his counsel, whether counsel be appointed under a legal aid scheme or be privately financed (Kamasinski v. Article 6 § 1 may sometimes compel the State to provide for the assistance of a lawyer when such assistance proves indispensable for an effective access to court either because legal representation is rendered compulsory, as is done by the domestic law of certain Contracting States for various types of litigation, or by reason of the complexity of the procedure or of the case (Airey v. Ireland, judgment of 9 October 1979, Series A no. 32, § 26).
