In the context of Article 8 of the Convention, the Court has on several occasions accepted that parents who did not have parental rights could apply to it on behalf of their minor children (see Scozzari and Giunta v. Italy [GC], nos. 39221/98 and 41963/98, §§ 138-39, ECHR 2000-VIII), the key criterion for the Court in these cases being the risk that some of the children's interests might not be brought to its attention, and that they would be denied effective protection of their Convention rights (see, mutatis mutandis, Lambert and Others v. France [GC], no. 46043/14, § 94, ECHR 2015 (extracts)).
