Auszug aus EGMR, 17.01.2006 - 50278/99
It added that the Convention was a living instrument which had to be interpreted in the light of present-day conditions (see Tyrer v. the United Kingdom, 25 April 1978, § 31, Series A no. 26). - EGMR, 20.03.1991 - 15576/89
CRUZ VARAS ET AUTRES c. SUÈDE
Auszug aus EGMR, 17.01.2006 - 50278/99
The Government, referring to the Court's judgment in Cruz Varas and Others v. Sweden (20 March 1991, Series A no. 201), considered that the applicant's removal had not interfered with his right under Article 34 of the Convention to lodge an individual application with the Court without the effective exercise of that right being hindered in any way by the State.

Demir und Baykara ./. Türkei - Streikrecht für Beamte
In the same vein, the Court held in its Aoulmi v. France judgment of 17 January 2006 (no. 50278/99, ECHR 2006-... ) that there had been a violation of Article 34 of the Convention, dismissing the respondent Government's argument to the effect that the applicant's expulsion had taken place prior to the adoption by the Court, in its Mamatkulov and Askarov judgment of 4 February 2005 (cited above), of its new case-law as to the binding nature of measures indicated under Rule 39 of the Rules of Court. - EGMR, 20.02.2007 - 35865/03
Mohammed Ali Hassan Al-Moayad
Randnr. 108;… Sahamayev , a.a.O, Randnr. 473; und Aoulmi ./. Frankreich , Individualbeschwerde Nr. 50278/99, Randnr. 103, ECHR 2006-...). - EGMR, 07.12.2021 - 57467/15
SAVRAN c. DANEMARK
France, no 50278/99, CEDH 2006-I (extraits), Ndangoya c. Suède (déc.), no 17868/03, 22 juin 2004, et Bensaid c. Royaume-Uni, no 44599/98, CEDH 2001-I).
- EGMR, 02.10.2012 - 14743/11
ABDULKHAKOV v. RUSSIA
As such, being intended to ensure the continued existence of the matter that is the subject of the application, the interim measure goes to the substance of the Convention complaint (see Mamatkulov and Askarov, cited above, § 108; Shamayev and Others, cited above, § 473; and Aoulmi v. France, no. 50278/99, § 103, ECHR 2006-I (extracts)). - EGMR, 10.03.2009 - 39806/05
Paladi ./. Republik Moldau
- EGMR, 10.08.2006 - 24668/03
OLAECHEA CAHUAS v. SPAIN
France, no 50278/99, § 103, CEDH 2006-I (extraits)). - EGMR, 05.02.2013 - 67286/10
ZOKHIDOV v. RUSSIA
Consequently, the interim measure is sought by the applicant, and granted by the Court, in order to facilitate the "effective exercise" of the right of individual petition under Article 34 of the Convention in the sense of preserving the subject matter of the application when that is judged to be at risk of irreparable damage through the acts or omissions of the respondent State (see Mamatkulov and Askarov, cited above, § 108; Shamayev and Others, cited above, § 473; and Aoulmi v. France, no. 50278/99, § 103, ECHR 2006-I (extracts)). - EGMR, 13.10.2016 - 31928/15
KONOVALCHUK v. UKRAINE
According to the Court's established case-law, a respondent State's failure to comply with an interim measure entails a violation of the right of individual application (see Mamatkulov and Askarov v. Turkey [GC], nos. 46827/99 and 46951/99, § 125, ECHR 2005-I; Aoulmi v. France, no. 50278/99, § 108, ECHR 2006-I (extracts)). - EGMR, 24.02.2009 - 246/07
BEN KHEMAIS c. ITALIE
Espagne, no 24668/03, 10 août 2006, Aoulmi c. France, no 50278/99, 17 janvier 2006, Chamaïev et autres c. Géorgie et Russie, no 36378/02, CEDH 2005-III, et Mamatkoulov et Askarov, précité). - EGMR, 15.05.2012 - 33809/08
