In line with its findings in S. and Marper v. the United Kingdom ([GC], nos. 30562/04 and 30566/04, § 103, ECHR 2008), the Court is of the view that the need for such safeguards is all the greater where the protection of personal data undergoing automatic processing is concerned, not least when such data are used for police purposes.

While the Court had found, in Jamil, that imprisonment in default was a penalty, on the ground that "[t]he sanction imposed on Mr Jamil was ordered by a criminal court, was intended to be deterrent and could have led to a punitive deprivation of liberty" (§ 32), it had also ruled that special supervision was not comparable to a criminal sanction since it was designed to prevent the commission of offences (they referred to Raimondo v. Entsprechend qualifizierte der EGMR eine nach der Verurteilung des dortigen Beschwerdeführers eingeführte (vgl. EGMR, Gardel v. Frankreich, Urteil vom 17. Dezember 2009, Nr. 16428/05, § 37) französische Regelung zur Eintragung von verurteilten Sexualstraftätern in ein spezielles Register, auf das die Behörden und die Polizei zugreifen können (vgl. EGMR, Gardel v. Frankreich, Urteil vom 17. Dezember 2009, Nr. 16428/05, § 16 ff.), nicht als Strafe.Die Maßnahme solle Personen von der Begehung neuer Taten abhalten und im Falle einer Tatbegehung ihre Identifizierung und Auffindung sicherstellen (vgl. EGMR, Gardel v. Frankreich, Urteil vom 17. Dezember 2009, Nr. 16428/05, § 42).
Daher stehe der präventive Charakter der Maßnahme im Vordergrund (vgl. EGMR, Gardel v. Frankreich, Urteil vom 17. Dezember 2009, Nr. 16428/05, § 43).
Der Umstand, dass ein Verstoß strafbewehrt sei, ändere daran nichts, weil bei einem Verstoß ein gänzlich neues Verfahren eingeleitet würde (vgl. EGMR, Gardel v. Frankreich, Urteil vom 17. Dezember 2009, Nr. 16428/05, § 44).

April 2018), zur unbefristeten Aufbewahrung von Fingerabdrücken, Zellproben und DNA-Profilen nach einem Strafverfahren (…S. und Marper, a. a. O.), zur Registrierung (metering) oder Erhebung von Nutzungs- oder Verkehrsdaten (Malone./. Vereinigtes Königreich, Individualbeschwerde Nr. 8691/79, 2. August 1984, Copland./. Vereinigtes Königreich, Individualbeschwerde Nr. 62617/00, 3. April 2007) oder zur Aufnahme von Sexualstraftätern in eine automatisierte nationale Datei der Justizbehörden nach einer Verurteilung wegen Vergewaltigung (B.B../. Frankreich, Individualbeschwerde Nr. 5335/06, Gardel./. Frankreich, Individualbeschwerde Nr. 16428/05 und M.B../. Frankreich, Individualbeschwerde Nr. 22115/06, alle 17.
