HANDYSIDE v. THE UNITED KINGDOM
Auszug aus EGMR, 18.03.2021 - 26933/15
The Court has repeated time and again the distinction that needs to be made between statements of fact and value judgments (see, among many other authorities, Morice v. France [GC], no. 29369/10, § 126, ECHR 2015) as well as the point that Article 10 protects not only "information" or "ideas" that are favourably received or regarded as inoffensive, but also those that offend, shock or disturb (see, among many other authorities, Handyside v. the United Kingdom, 7 December 1976, § 49, Series A no. 24).
