    M. AND OTHERS v. CROATIA

The Court is aware that this situation was sensitive for a country that was in war and also accepts that during the war and at the beginning of the county's independence the State authorities were faced with a difficult situation (compare to B. and Others v. Croatia, no. 71593/11, § 62, 18 June 2015).

    LUKIC AND OTHERS v. CROATIA

The obligation to protect the right to life under Article 2 of the Convention, read in conjunction with the State's general duty under Article 1 of the Convention to "secure to everyone within [its] jurisdiction the rights and freedoms defined in [the] Convention", also requires by implication that there should be some form of effective official investigation when individuals have been killed as a result of the use of force (see, mutatis mutandis, McCann and Others, 27 September 1995, § 161, Series A no. 324; Kaya v. Turkey, 19 February 1998, § 86, Reports of Judgments and Decisions 1998-I; and B. and Others v. Croatia, no. 71593/11, § 57, 18 June 2015).

    COSIC v.

    BALIUCIAI v. LITHUANIA

The requirements of Article 2 go beyond the stage of the official investigation, where this has led to the institution of proceedings in the national courts: the proceedings as a whole, including the trial stage, must satisfy the requirements of the positive obligation to protect lives through the law (see B. and Others v. Croatia, no. 71593/11, § 61, 18 June 2015, and the cases cited therein).
