  • EGMR, 22.03.2001 - 34044/96

    Schießbefehl

    Auszug aus EGMR, 19.02.2008 - 74357/01
The Court recalls the general principles established in its case-law concerning Article 7 of the Convention and set out in such cases as Streletz, Kessler and Krenz v. Germany ([GC], nos. 34044/96, 35532/97 and 44801/98, §§ 49-50, ECHR 2001-II), quoting, inter alia, from the S.W. v. the United Kingdom judgment of 22 November 1995 (Series A no. 335-B, pp. 41-42, §§ 34-36) as follows:.

    Transnistrien

    Auszug aus EGMR, 19.02.2008 - 74357/01
Thus, under international law, Lithuania had never been a lawful part of the USSR and no Soviet law could have been applied to Lithuania in the course of the restoration of its independence (see the International Law Commission's Draft Articles on the Responsibility of States for Internationally Wrongful Acts, and Ilascu and Others v. Moldova and Russia [GC], no. 48787/99, §§ 320-321, ECHR 2004-VII).

    SIDABRAS ET DZIAUTAS c. LITUANIE

    Auszug aus EGMR, 19.02.2008 - 74357/01
There had been no uncertain transitional period, as has been already recognised by the Court in its case-law (Sidabras and Dziautas v. Lithuania, nos. 55480/00 and 59330/00, §§ 40, 54 and 60, ECHR 2004-VIII; cf. the aforementioned Ilascu case, §§ 31 and 325).
  • EGMR, 25.05.1993 - 14307/88

    KOKKINAKIS c. GRÈCE

    Auszug aus EGMR, 19.02.2008 - 74357/01
Accordingly, as the Court held in its Kokkinakis v. Greece judgment of 25 May 1993 (Series A no. 260-A, p. 22, § 52), Article 7 is not confined to prohibiting the retrospective application of the criminal law to an accused's disadvantage: it also embodies, more generally, the principle that only the law can define a crime and prescribe a penalty (nullum crimen, nulla poena sine lege) and the principle that the criminal law must not be extensively construed to an accused's detriment, for instance by analogy.

    S.W. c. ROYAUME-UNI

  • EGMR, 13.07.1995 - 18139/91

TOLSTOY MILOSLAVSKY v. THE UNITED KINGDOM

    Auszug aus EGMR, 19.02.2008 - 74357/01
The Court thus indicated that when speaking of "law" Article 7 alludes to the very same concept as that to which the Convention refers elsewhere when using that term, a concept which comprises written as well as unwritten law and implies qualitative requirements, notably those of accessibility and foreseeability (see... the Tolstoy Miloslavsky v. the United Kingdom judgment of 13 July 1995, Series A no. 316-B, pp. 71-72, § 37).
  • EGMR, 09.10.2008 - 62936/00

    MOISEYEV v. RUSSIA

The Court considers that the consequences of failure to comply with those laws were adequately foreseeable, not only with the assistance of legal advice, but also as a matter of common sense (compare Kuolelis and Others v. Lithuania, nos. 74357/01, 26764/02 and 27434/02, § 121, 19 February 2008).

MEL v. LITHUANIA and 2 other qpplicqtions

On that date the Soviet army conducted military operations against the Government of Lithuania and Soviet troops forcibly occupied the buildings of the Ministry of Defence, the Vilnius television tower, the Lithuanian public television and media headquarters and the Vilnius train station, and tried to take the seat of the Lithuanian Parliament and other authorities; thirteen Lithuanian civilians were killed and over a thousand injured as a result of the conflict with the Soviet army during the night of 12 to 13 January 1991 (the relevant historical and political background has been summarised in Kuolelis and Others v. Lithuania, nos. 74357/01 and 2 others, §§ 7-25, 19 February 2008).
  • EGMR - 55221/17 (anhängig)

    MIHAILOVS v. LITHUANIA

Has there been a violation of Article 7 of the Convention on account of the fact that the applicant was convicted for crimes against humanity (see Korbely v. Hungary [GC], no. 9174/02, §§ 69-73, ECHR 2008; for the historical background, see Kuolelis and Others v. Lithuania, nos. 74357/01 and 2 others, §§ 115-117, 19 February 2008; also see, mutatis mutandis, Zdanoka v. Latvia [GC], no. 58278/00, §§ 95 and 96, ECHR 2006-IV)?.
