DU ROY ET MALAURIE c. FRANCE
Auszug aus EGMR, 19.06.2003 - 49017/99
Also of relevance for the balancing of competing interests which the Court must carry out is the fact that under Article 6 § 2 of the Convention individuals have a right to be presumed innocent of any criminal offence until proven guilty (see inter alia Worm v. Austria, judgment of 29 August 1997, Reports 1997-V, § 50 and Du Roy and Malaurie v. France, no. 34000/96, § 34, ECHR 2000-X). - EGMR, 20.05.1999 - 21980/93
BLADET TROMSØ ET STENSAAS c. NORVEGE
Auszug aus EGMR, 19.06.2003 - 49017/99
The Court therefore finds that the allegation consisted of a factual statement (cf., for instance, the Lingens v. Austria judgment of 8 July 1986, Series A no. 103, p. 28, § 46 and Bladet Tromsø and Stensaas v. Norway [GC], no. 21980/93, ECHR 1999-III). - EGMR, 26.04.1979 - 6538/74
SUNDAY TIMES c. ROYAUME-UNI (N° 1)
Auszug aus EGMR, 19.06.2003 - 49017/99
The Court reiterates its well-established case-law, whereby the test of necessity in a democratic society requires the Court to determine whether the "interference" complained of corresponded to a "pressing social need", whether it was proportionate to the legitimate aim pursued and whether the reasons given by the national authorities to justify it are relevant and sufficient (see the Sunday Times (no. 1) v. the United Kingdom judgment of 26 April 1979, Series A no. 30, p. 38, § 62).

PRAGER ET OBERSCHLICK c. AUTRICHE
Auszug aus EGMR, 19.06.2003 - 49017/99
In addition, the Court is mindful of the fact that journalistic freedom also covers possible recourse to a degree of exaggeration, or even provocation (see the Prager and Oberschlick v. Austria judgment of 26 April 1995, Series A no. 313, p. 19, § 38). - EGMR, 25.03.1999 - 25444/94
PÉLISSIER AND SASSI v. FRANCE
Auszug aus EGMR, 19.06.2003 - 49017/99
The Court reiterates that the reasonableness of the length of the proceedings is to be assessed in the light of the particular circumstances of the case, regard being had to the criteria laid down in the Court's case-law, in particular the complexity of the case, the conduct of the applicant and that of the authorities before which the case was brought (cf. Pélissier and Sassi v. France [GC], no. 25444/94, ECHR 1999-II, § 67). - EGMR, 23.09.1994 - 15890/89
JERSILD v. DENMARK
Auszug aus EGMR, 19.06.2003 - 49017/99
Although the press must not overstep certain bounds, in particular in respect of the reputation and rights of others and the need to prevent the disclosure of confidential information, its duty is nevertheless to impart - in a manner consistent with its obligations and responsibilities - information and ideas on all matters of public interest (see the Thorgeir Thorgeirson v. Iceland judgment of 25 June 1992, Series A no. 239, p. 27, § 63; the Jersild v. Denmark judgment of 23 September 1994, Series A no. 298, p. 23, § 31 and the De Haes and Gijsels v. Belgium judgment of 24 February 1997, Reports of Judgments and Decisions 1997-I, pp. 233-34, § 37). - EGMR, 25.06.1992 - 13778/88
THORGEIR THORGEIRSON v. ICELAND
