    VUCKOVIC v. CROATIA

The Court reiterates at the outset that rape and serious sexual assault amount to treatment that falls within the ambit of Article 3 of the Convention and also engages fundamental values and essential aspects of "private life" within the meaning of Article 8 (see Y v. Bulgaria, no. 41990/18, §§ 63-64, 20 February 2020, and the cases cited therein).

It is not for the Court to say whether the national courts properly assessed the interplay of those factors; the Court cannot act as a domestic criminal court or hear appeals against the decisions of national courts, and it is not for it to pronounce on any points of criminal liability (see, among other authorities, Myumyun, cited above, § 75, and Y v. Bulgaria, no. 41990/18, § 94, 20 February 2020).

  • EGMR, 13.02.2024 - 38588/21

    X v. GREECE

Since rape and serious sexual assault typically implicate fundamental values and essential aspects of "private life", the Court has also examined cases relating to the positive obligation to investigate cases of rape under Article 8 of the Convention (see, for instance, M.C. v. Bulgaria, no. 39272/98, §§ 149-53, ECHR 2003-XII, and Y v. Bulgaria, no. 41990/18, §§ 62-65, 20 February 2020, and the case-law cited therein).
  • EGMR, 28.11.2023 - 18269/18

    KRACHUNOVA v. BULGARIA

Firstly, it is not for the Court to rule on any points regarding individual criminal liability (see Tanli v. Turkey, no. 26129/95, § 111 in fine, ECHR 2001-III (extracts); M.C. v. Bulgaria, no. 39272/98, § 168 in fine, ECHR 2003-XII; and Y v. Bulgaria, no. 41990/18, § 94, 20 February 2020).
  • EGMR, 27.05.2021 - 5671/16

    J.L. c. ITALIE

Elle rappelle que les obligations positives qui pèsent sur les États membres en vertu des articles 3 et 8 de la Convention commandent l'incrimination et la répression effective par des mesures pénales de tout acte sexuel non consensuel (voir, entre autres, M.C. c. Bulgarie, no 39272/98, § 166, CEDH 2003-XII, et Y. c. Bulgarie, no 41990/18, § 95, 20 février 2020).
  • EGMR, 14.06.2022 - 56070/18

    STOYANOVA v. BULGARIA

The Court cannot act as a domestic criminal court or hear appeals against national courts' decisions, and it is not for it to pronounce on any points of criminal liability (see, among other authorities, Myumyun, cited above, § 75, and Y v. Bulgaria, no. 41990/18, § 94, 20 February 2020).
  • EGMR, 13.04.2021 - 37882/13

Bulgarie ([GC], no 22457/16, §§ 184-190, 2 février 2021), Y c. Bulgarie (no 41990/18, §§ 80-83, 20 février 2020), et Z c. Bulgarie (no 39257/17, §§ 65-69, 28 mai 2020).
