    The Court and Commission have taken the view that, for purposes of conviction and sentencing, Article 6 does not prevent domestic courts from having regard to an existing criminal record (see, for example, X v.     Secondly, in stating that no "criminal charge" was in issue, they referred in addition to the criteria developed by the Court in its case-law, namely "whether or not the text defining the offence in issue belongs, according to the legal system of the respondent State, to criminal law; next, the nature of the offence and, finally, the nature and degree of severity of the penalty that the person concerned risked incurring" (Öztürk v.
