The Court recalls that the general principles regarding the right "to trial within a reasonable time or to release pending trial, as guaranteed by Article 5 § 3 of the Convention were stated in a number of its previous judgments (see, among many other authorities, Kudla v. Poland [GC], no. 30210/96, § 110 et seq, ECHR 2000-XI; and McKay v. the United Kingdom [GC], no. 543/03, §§ 41-44, ECHR 2006-..., with further references).

STAYKOV c. BULGARIE
Pour apprécier le comportement dont les autorités ont fait preuve en l'espèce lorsqu'elles ont examiné l'intérêt public et le droit à la liberté du requérant, la Cour tiendra compte des circonstances découlant des soupçons des autorités nationales selon lesquels le requérant jouait un rôle essentiel dans l'activité criminelle organisée (voir, mutatis mutandis, Bak c. BURZA v. POLAND
The Court notes that the arguments raised by the Government are similar to those already examined and rejected in previous cases against Poland (see Tomecki v. Poland, no. 47944/06, §§ 19-21, 20 May 2008, and Bielski v. Poland and Germany, no. 18120/03, §§ 31-35, 3 May 2011) and that the Government have not submitted any new circumstances which would lead the Court to depart from its previous findings. - EGMR, 03.05.2011 - 18120/10 Der Gerichtshof stellt ferner fest, dass die von der Regierung angeführten Argumente jenen ähneln, die in früheren Fällen gegen Polen bereits geprüft und zurückgewiesen worden waren (siehe Tomecki ./. Polen, Individualbeschwerde Nr. 47944/06, Rdnrn. 19-21, 20. Mai 2008, und Buta ./. Polen, Individualbeschwerde Nr. 18368/02, Rdnrn. 25-27, 28. November 2006), und dass die Regierung keine neuen Tatsachen vorgetragen hat, die den Gerichtshof dazu veranlassen würden, von seinen früheren Feststellungen abzuweichen.
