    M.P. AND OTHERS v. BULGARIA

    Auszug aus EGMR, 20.06.2019 - 7144/15
Given the nature and substance of the applicant's complaints, they fall to be examined under Articles 3 and 8 of the Convention, both of which entail an obligation on the State to safeguard the physical and psychological integrity of a person (see X and Y v. the Netherlands, cited above, §§ 22-23; M. and C. v. Romania, no. 29032/04, §§ 107-11, 27 September 2011; M.P. and Others v. Bulgaria, no. 22457/08, §§ 108-10, 15 November 2011; and Okkali v. Turkey, no. 52067/99, § 54, ECHR 2006 XII (extracts)).

After all relevant evidence had been gathered, the prosecution authorities concluded that there had been insufficient evidence for the prosecution of C. The Court, for its part, does not consider itself to be in a position to draw a conclusion on the issue, and reiterates that it cannot substitute its own findings of fact for those of the national authorities, which are better placed to assess the evidence adduced before them and the importance of witness testimony (see M.P. and Others v. Bulgaria, no. 22457/08, § 112, 15 November 2011).

    BOCHAN v. UKRAINE (No. 2)

    Auszug aus EGMR, 20.06.2019 - 7144/15
All these persons, if they do not join in as co-applicants, are not parties to the proceedings before the Court (see my separate opinion appended to the judgment in the case of Bochan v. Ukraine (no. 2), [GC], no. 22251/08, ECHR 2015).

CENTRE FOR LEGAL RESOURCES ON BEHALF OF VALENTIN CÂMPEANU v. ROMANIA

    Auszug aus EGMR, 20.06.2019 - 7144/15
The Court has certainly consistently shown itself flexible enough for cases advanced by representatives of those who are vulnerable by reason of their age, sex or disability, which rendered them unable to lodge a complaint on their own behalf with the Court to be entertained: see S.P., D.P. and A.T. v. the United Kingdom, no. 23715/94, Commission decision of 20 May 1996, unreported and Centre for Legal Resources on behalf of Valentin Câmpeanu v. Romania [GC], no. 47848/08, § 103, ECHR 2014.

    HANDYSIDE v. THE UNITED KINGDOM

    Auszug aus EGMR, 20.06.2019 - 7144/15
We do not in any way call into question the conclusion reached by the prosecution authorities, nor do we believe that the Court should assess in any respect the responsibility of C. However, we find that the steps taken before reaching that conclusion did not comply with the State's procedural obligations under Articles 3 and 8 of the Convention (see, mutatis mutandis, Handyside v. the United Kingdom, 7 December 1976, § 49, Series A no. 24, and Sandra Jankovic v. Croatia, no. 38478/05, § 46, 5 March 2009).

    S.P., D.P. and A.T. v. THE UNITED KINGDOM

    Auszug aus EGMR, 20.06.2019 - 7144/15
The Court has certainly consistently shown itself flexible enough for cases advanced by representatives of those who are vulnerable by reason of their age, sex or disability, which rendered them unable to lodge a complaint on their own behalf with the Court to be entertained: see S.P., D.P. and A.T. v. the United Kingdom, no. 23715/94, Commission decision of 20 May 1996, unreported and Centre for Legal Resources on behalf of Valentin Câmpeanu v. KARNER c. AUTRICHE

    Auszug aus EGMR, 20.06.2019 - 7144/15
This criterion is not to be applied in a rigid, mechanical and inflexible way (see Karner v. Austria, no. 40016/98, § 25, ECHR 2003-IX).
  • EGMR, 04.12.2003 - 39272/98

    M.C. c. BULGARIE

    Auszug aus EGMR, 20.06.2019 - 7144/15
The Court has held that in such circumstances it falls upon the member States to ensure that efficient criminal-law provisions are in place (see, for example, M.C. v. Bulgaria, no. 39272/98, § 150, ECHR 2003-XII).
  • EGMR, 15.03.2016 - 61495/11

    M.G.C. v. ROMANIA

    Auszug aus EGMR, 20.06.2019 - 7144/15
The Court reiterates that in cases of sexual abuse children are particularly vulnerable (see M.C. v. Bulgaria, cited above, §§ 150 and 183; M.G.C. v. Romania, no. 61495/11, § 56, 15 March 2016).

    TADIC v. CROATIA

    Auszug aus EGMR, 20.06.2019 - 7144/15
Positive obligations of the states under Article 3 and 8 of the Convention also include requirements related to the effectiveness of the investigation (see M.C. v. Bulgaria, cited above, §§ 150-152 and, as regards general principles, Armani Da Silva v. the United Kingdom [GC], no. 5878/08, §§ 233-238, 30 March 2016; Bouyid v. Belgium [GC], no. 23380/09, §§ 114-123, ECHR 2015; and Tadic v. Croatia, no. 10633/15, § 66, 23 November 2017).

What are the Challenges for the ECHR?", in P. Pinto de Albuquerque and K. Wojtyczek (eds.), Judicial Power in a Globalized World: Liber Amicorum Vincent De Gaetano, 2019; Judge Wojtyczek, Concurring opinions in Bochan v. Ukraine (no. 2) [GC], no. 22251/08, ECHR 2015, and A. and B. v. Croatia, no. 7144/15, 20 June 2019.
  • EGMR, 27.05.2021 - 5671/16

    J.L. c. ITALIE

Les dispositions en jeu impliquent une prise en charge adéquate de la victime durant la procédure pénale, ceci dans le but de la protéger d'une victimisation secondaire (Y. c. Slovénie, précité, §§ 97 et 101, A et B c. Croatie, no 7144/15, § 121, 20 juin 2019, et N.Ç. c. Turquie, précité, § 95).
  • EGMR, 14.01.2021 - 50231/13

    SABALIC v. CROATIA

Firstly, the Court's judgment directly affects M.M."s fundamental rights, whereas this person has never been heard in the proceedings before the Court (on this issue, see my separate opinions appended to the judgments in the following cases: Bochan v. Ukraine (no. 2) [GC], no. 22251/08, ECHR 2015; Kosmas and Others v. Greece, no. 20086/13, 29 June 2017; A and B v. Croatia, no. 7144/15, 20 June 2019; and Liamberi and Others v. Greece, no. 18312/12, 8 October 2020).
  • EGMR, 16.09.2021 - 20741/10

    X v. POLAND

Procedural justice requires that all persons whose rights and interests may be affected by the outcome of the proceedings should be heard before a decision is taken (see, in particular: the powerful joint concurring opinion of Judges Ravarani and Elósegui, appended to the judgment A.M. and Others v. Russia, no. 47220/19, 6 July 2021; P. Pastor Vilanova, "Third Parties Involved in International Litigation Proceedings. What Are the Challenges for the ECHR?" in Judicial Power in a Globalized World. Liber Amicorum Vincent De Gaetano, P. Pinto de Albuquerque, K. Wojtyczek (eds.), Springer 2019; I refer also to my separate opinions, appended to the judgments in the cases of Bochan v. Ukraine (no. 2) [GC], no. 22251/08, ECHR 2015; Kosmas and Others v. Greece, no. 20086/13, 29 June 2017; A and B v. Croatia, no. 7144/15, 20 June 2019; and Smiljanic v. Croatia, no. 35983/14, 25 March 2021; also to K. Wojtyczek, "Procedural justice and the proceedings before the European Court of Human Rights: who should have the right to be heard?" in: Fair trial: regional and international perspectives: Liber Amicorum Linos-Alexandre Sicilianos./ Procès équitable: perspectives regionales et internationales: Liber Amicorum Linos-Alexandre Sicilianos, R. Spano et al.

    A.S. ET M.S. c. ITALIE

Croatie, no 7144/15, § 3, 20 juin 2019.
  • EGMR, 28.07.2020 - 53028/14

    MONICA MACOVEI v. ROMANIA

Procedural justice requires that all persons who may be directly affected by a decision be heard before that decision is rendered: audiatur et altera pars (see my separate opinions appended to the judgments in the cases of Bochan v. Ukraine (no. 2) [GC], no. 22251/08, 5 February 2015; and A and B v. Croatia, no. 7144/15, 20 June 2019; see also P. Pastor Vilanova, "Third Parties Involved in International Litigation Proceedings.

    LIAMBERI ET AUTRES c.

Ukraine (no 2) [GC], no 22251/08, CEDH 2015, et A et B c. Croatie, no 7144/15, 20 juin 2019).

    X ET AUTRES c. BULGARIE

We would point out, in this regard, that the Court has already referred to the Lanzarote Convention as a source of inspiration in a context similar to the one at hand (see A and B v. Croatia, no. 7144/15, §§ 78, 80 and 116, 20 June 2019).
  • EGMR, 19.11.2020 - 1920/14

    PROJECT-TRADE D.O.O. v. CROATIA

However, the issue whether an applicant can claim to be a victim of the violation complained of is a matter which goes to the Court's jurisdiction, and which the Court must thus examine of its own motion (see Buzadji v. the Republic of Moldova [GC], no. 23755/07, § 70, ECHR 2016 (extracts), and A and B v. Croatia, no. 7144/15, § 88, 20 June 2019).

    D.K. c. ITALIE
