The Court recalls its case-law that the impossibility for an applicant to obtain the execution of a judgment in his or her favour constitutes an interference with the right to the peaceful enjoyment of possessions, as set out in the first sentence of the first paragraph of Article 1 of Protocol No. 1 (see, among other authorities, Burdov v. Russia, no. 59498/00, § 40, ECHR 2002-III; JasiÅ«niene v. Lithuania, no. 41510/98, § 45, 6 March 2003).

La Cour rappelle aussi avoir conclu à la violation de l'article 1 du Protocole no 1 dans l'affaire Chmalko c. Il apparaît donc que l'administration a omis de se conformer dans un délai raisonnable à l'arrêt no 800/2004 de la cour administrative d'appel, ce qui est incompatible avec l'article 6 § 1 de la Convention (voir, parmi d'autres, Prodan c. IZZO AND OTHERS v. ITALY
The Court reiterates that the reasonableness of any delay in enforcing a binding judgment must be assessed in the light of the circumstances of the case and that it will depend on different factors, such as the complexity of the enforcement proceedings, the applicant's behaviour and that of the competent authorities, the amount and nature of the court award (see Burdov v. Russia (no. 2), no. 33509/04, § 66, ECHR 2009, and Raylyan v. Russia, no. 22000/03, §§ 31-34, 15 February 2007) and the applicant's personal situation, including factors such as his age, state of health, and nature of any possible disability (see Shmalko v. Ces éléments suffisent à la Cour pour conclure que les autorités nationales ne se sont pas conformées dans un délai raisonnable à la décision no 949/2009 du tribunal de première instance d'Athènes, privant ainsi cette décision de tout effet utile au mépris de l'article 6 § 1 de la Convention (voir, parmi d'autres, Prodan c. Moldova, no 49806/99, §§ 54-55, CEDH 2004-II, Chmalko c. Ukraine, no 60750/00, § 46, 20 juillet 2004, et Vasiliadou, précité, § 37).
