PÉLISSIER AND SASSI v. FRANCE
Auszug aus EGMR, 20.10.2005 - 71841/01
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II). - EGMR, 15.07.1982 - 8130/78
Eckle ./. Deutschland
Auszug aus EGMR, 20.10.2005 - 71841/01
As to the Government's contention that the applicant is not a "victim" within the meaning of Article 34, the Court recalls that a reduction in sentence can have the effect of rendering an applicant "no longer a victim" if the reduction is measurable and is expressly directed to the excessive length of the proceedings (in Eckle v. Germany, (judgment of 15 July 1982, Series A no. 51, § 65 - 70) the applicant could continue to claim to be a victim; in Lie and Berntsen v. Norway (no. 25130/94, dec. 16 December 1999) and Van Laak v. the Netherlands, (no.17669/91, Commission decision of 31 March 1993, DR 74, p. 156) he could not).
