LINGENS v. AUSTRIA
- EGMR, 07.12.1976 - 5493/72
HANDYSIDE v. THE UNITED KINGDOM

- EGMR, 17.05.2016 - 33677/10
FÜRST-PFEIFER v. AUSTRIA
Nonetheless the Court observes that those who act in an official capacity must enjoy public confidence in conditions free of undue perturbation if they are to be successful in performing their tasks and it may therefore prove necessary to protect them from offensive and abusive verbal attacks when on duty (see Janowski v. Poland [GC], no. 25716/94, § 33, ECHR 1999-I).The Chamber refers (in paragraph 46) to July and SARL Libération v. France (no. 20893/03, § 74, ECHR 2008 (extracts)) and (in paragraph 47) to Janowski v. Poland ([GC], no. 25716/94, § 33, ECHR 1999-I).
- EGMR, 21.03.2002 - 31611/96
NIKULA c. FINLANDE
It may therefore prove necessary to protect them from offensive and abusive verbal attacks when on duty (see Janowski v. Poland [GC], no. 25716/94, § 33, ECHR 1999-I, with further references).
- EGMR, 29.03.2001 - 38432/97
THOMA v. LUXEMBOURG
He submitted that staff from the Water and Forestry Commission could not be regarded as entitled to the special protection that was afforded in Janowski v. Poland ([GC], no. 25716/94, ECHR 1999-I), as the facts of that case were distinguishable from those in the instant case. - EGMR, 28.09.1999 - 28114/95
DALBAN v. ROMANIA
Since the complaints in question were not raised before the Commission when the admissibility of the application was being examined, they are not part of the case referred to the Court (see, among other authorities and mutatis mutandis, Janowski v. Poland [GC], no. 25716/94, § 19, ECHR 1999-I). - EGMR, 03.04.2012 - 43206/07
Kaperzyński ./. Polen
As set forth in Article 10 § 2, this freedom is subject to exceptions, which must, however, be construed strictly, and the need for any restrictions must be established convincingly (see, among many other authorities, Janowski v. Poland [GC], no. 25716/94, § 30, ECHR 1999-I; Nilsen and Johnsen v. Norway [GC], no. 23118/93, § 43, ECHR 1999-VIII; and Lingens v. Austria, 8 July 1986, § 41, Series A no. 103).In this context, the safeguards to be afforded to the press are of particular importance (Janowski v. Poland [GC], no. 25716/94, § 30, ECHR 1999-I).

TAFFIN ET CONTRIBUABLES ASSOCIES c. FRANCE
Danemark, 23 septembre 1994, série A no 298, pp. 23-24, § 31, Janowski c. Pologne [GC], no 25716/94, § 30, CEDH 1999-I, et Nilsen et Johnsen c. Pologne [GC] du 21 janvier 1999 no 25716/94, CEDH 1999-I, § 33 ; Busuioc c. Moldavie du 21 décembre 2004, no 61513/00, § 64 et Mamère, précité, § 27).

KURLOWICZ v. POLAND
As set forth in Article 10, this freedom is subject to exceptions, which must, however, be construed strictly, and the need for any restrictions must be established convincingly (see, among many other authorities, Janowski v. Poland [GC], no. 25716/94, § 30, ECHR 1999-I; Nilsen and Johnsen v. Norway [GC], no. 23118/93, § 43, ECHR 1999-VIII; and Lingens v. Austria, 8 July 1986, § 41, Series A no. 103).The Court further notes that, in contrast to cases such as Sanocki v. Poland, no. 28949/03, § 5, 17 July 2007, or Janowski v. Poland [GC], no. 25716/94, § 14, ECHR 1999-I, the statements made by the applicant did not contain any offensive statements ad personam.

Although it cannot be said that civil servants are deprived of all protection against offensive and abusive verbal attacks in relation to the exercise of their duties (cf. Janowski v. Poland (GC), no. 25716/94, § 33, ECHR 1999-I), it has to be taken into account that in the present case the criticism was strictly limited to Mr W.'s actions as an investigating officer in the case against the applicant's client, as distinct from criticism focusing on Mr W.'s general professional or other qualities. - EGMR, 03.12.2013 - 64520/10
UNGVÁRY AND IRODALOM KFT. v. HUNGARY
However, the courts - the guarantors of justice, whose role is fundamental in a State based on the rule of law - must enjoy public confidence; and it may therefore prove necessary to protect judges from offensive and abusive verbal attacks (see De Haes and Gijsels v. Belgium, 24 February 1997, § 37, Reports 1997-I; Janowski v. Poland [GC], no. 25716/94, § 33, ECHR 1999-I). - EGMR, 05.11.2020 - 73087/17
