DURDAJ AND OTHERS v. ALBANIA
The relevant principles applicable to the effective investigation have been summarised by the Court on many occasions as follows (see, for example, Armani Da Silva v. the United Kingdom [GC], no. 5878/08, §§ 229-39, 30 March 2016): those responsible for carrying out an investigation must be independent from those implicated in the events in question; the investigation must be "adequate"; its conclusions must be based on thorough, objective and impartial analysis of all relevant elements; it must be carried out promptly and with reasonable expedition (ibid., § 240); and the victim or the next of kin when the victim did not survive should be able to participate effectively in the investigation in one form or another to the extent necessary to safeguard their legitimate interests (see El-Masri v. the former Yugoslav Republic of Macedonia [GC], no. 39630/09, § 185, ECHR 2012, and Ne?.koska v. the former Yugoslav Republic of Macedonia, no. 60333/13, § 49, 21 January 2016).
