Nach seiner Rechtsprechung garantiert Art. 13 eine wirksame Beschwerde bei einer innerstaatlichen "Instanz" für jeden, der aus vertretbaren Gründen (motifs défendables / arguable grounds) behauptet, Opfer einer Verletzung der von der Konvention anerkannten Rechte und Freiheiten zu sein; jegliche andere Auslegung würde ihn seines Sinnes entleeren (s. zuletzt Urteil Boyle und Rice vom 27. April 1988, Série A Nr. 131, S. 23, Ziff. 52, EGMR-E 4, 60).Aus deren Entscheidung über die Zulässigkeit kann der Gerichtshof zweckdienliche Hinweise über die Vertretbarkeit des in Frage stehenden Beschwerdegrundes entnehmen (s. vorzitiertes Urteil Boyle und Rice, Série A Nr. 131, S. 23-24, Ziff. 54-55, EGMR-E 4, 60 f.).
