Dem steht nicht entgegen, dass sich die Rspr. des EGMR teilweise auch nur mit dem Verfahren in der Berufungsinstanz beschäftigt, wenn nur bei diesem Anhaltspunkte für eine unangemessene Verfahrensdauer bestanden (…1 Jahr Verfahrensdauer am Amtsgericht und neun Jahre in der Berufungsinstanz: 24. Rechtsschutz wegen der überlangen Dauer eines verwaltungsgerichtlichen Verfahrens
Bei anderer Gelegenheit beschränkt er sich jedoch auf die Feststellung der Verletzung des Art. 6 Abs. 1 EMRK wegen überlanger Dauer nur eines bestimmten Verfahrensabschnitts (EGMR…, Urteil vom 1. April 2010, Beschwerde Nr. 12852/08, Rn. 48;… Urteile vom 24. Juni 2010, Beschwerde Nr. 21423/07, Rn. 34, sowie Beschwerde Nr. 39444/08, Rn. 62 f.;… Urteil vom 21. Januar 2010, Beschwerden Nr. 42402/05 und 42423/05, Rn. 61; vgl. auch Grabenwarter/Pabel, in: Grote/Marauhn, EMRK, 2006, Rn. 105, unter Bezugnahme auf das Urteil des EGMR vom 21. Dezember 1999 [Beschwerde Nr. 26297/95], das allerdings [Rn. 37] ausdrücklich auch auf die Gesamt-Verfahrensdauer abstellt).
