LÓPEZ OSTRA c. ESPAGNE
Royaume-Uni, 21 février 1990, série A no 172, p. 18, § 40 ; López Ostra c. Espagne, 9 décembre 1994, série A no 303-C, pp. 54-55, § 51 ; Guerra et autres c. Italie, 19 février 1998, Recueil des arrêts et décisions 1998-I, p. 227, § 57).

WETTSTEIN v. SWITZERLAND
Suisse, no 33958/96, § 56, CEDH 2000-XII). - EGMR, 21.02.1990 - 9310/81
POWELL ET RAYNER c. ROYAUME-UNI

FADEÏEVA c. RUSSIE
Article 8 has been relied on in various cases involving environmental concern, yet it is not violated every time that environmental deterioration occurs: no right to nature preservation is as such included among the rights and freedoms guaranteed by the Convention (see Kyrtatos v. Greece, no. 41666/98, § 52, ECHR 2003-VI). - EGMR, 10.01.2012 - 30765/08
Di Sarno u.a. ./. Italien
Par ailleurs, ni l'article 8 ni aucune autre disposition de la Convention ne garantit spécifiquement une protection générale de l'environnement en tant que tel (Kyrtatos c. Grèce, no 41666/98, § 52, CEDH 2003-VI (extraits)). - EGMR, 15.01.2009 - 74651/01
Bürgerorganisation Radko und Paunkovski ./. Jugoslawien und Mazedonien
The Court reiterates that only such costs and expenses as were actually and necessarily incurred in connection with the violation found, and reasonable as to quantum, are recoverable under Article 41 (see Kyrtatos v. Greece, no. 41666/98, § 62, ECHR 2003-VI (extracts)).
- EGMR, 10.02.2011 - 30499/03
DUBETSKA AND OTHERS v. UKRAINE
The Court refers to its well-established case-law that neither Article 8 nor any other provision of the Convention guarantees the right to preservation of the natural environment as such (see Kyrtatos v. Greece, no. 41666/98, § 52, ECHR 2003-VI). - EGMR, 21.07.2015 - 31833/06
CINGILLI HOLDING A.S. AND CINGILLIOGLU v. TURKEY
By way of example, such cases have related to failure to: pay a debt or compensation (Burdov v. Russia, no. 59498/00, §§ 36-38, ECHR 2002-III; Timofeyev v. Russia, no. 58263/00, §§ 40-43, 23 October 2003; Metaxas v. Greece, no. 8415/02, §§ 25-26, 27 May 2004; and Simaldone v. Italy, no. 22644/03, §§ 48-56, 31 March 2009); comply with the annulment of an expropriation order (Katsaros v. Greece, no. 51473/99, §§ 33-35, 6 June 2002); restore property or pay compensation (Jasiuniene v. Lithuania, no. 41510/98, §§ 28-32, 6 March 2003, and Sabin Popescu v. Romania, no. 48102/99, §§ 68-76, 2 March 2004); demolish buildings (Kyrtatos v. Greece, no. 41666/98, §§ 31-32, ECHR 2003-VI (extracts), and Ruianu v. Romania, no. 34647/97, §§ 65-73, 17 June 2003); evict persons from a building (Prodan v. Moldova, no. 49806/99, §§ 50-56, ECHR 2004-III (extracts)); grant access to public documents (Kenedi v. Hungary, no. 31475/05, §§ 35-39, 26 May 2009); bring industrial and other activities to an end (Taskin and Others v. Turkey, no. 46117/99, §§ 135-138, ECHR 2004-X, and Okyay and Others v. Turkey, no. 36220/97, §§ 72-74, ECHR 2005-VII); employ a person (Castren-Niniou v. Greece, no. 43837/02, §§ 25-28, 9 June 2005); and hand over adopted children to their parents (Pini and Others v. Romania, nos. 78028/01 and 78030/01, §§ 174-189, ECHR 2004-V (extracts)). - EGMR, 18.01.2007 - 73819/01
ESTRIKH v. LATVIA
The Court reiterates that failure to abide by the time-limit prescribed by domestic law does not in itself contravene Article 6 § 1 of the Convention (see Wiesinger v. Austria, judgment of 30 October 1991, Series A no. 213, p. 22, § 60), however Article 6 § 1 imposes on the Contracting States the duty to organise their judicial systems in such a way that their courts can meet each of its requirements, including the obligation to hear cases within a reasonable time (Kyrtatos v. Greece, no. 41666/98, § 42, ECHR 2003-VI). - EGMR, 13.07.2017 - 38342/05
JUGHELI AND OTHERS v. GEORGIA
There is no explicit right in the Convention to a clean and quiet environment, but where an individual is directly and seriously affected by noise or other pollution, an issue may arise under Article 8 (see Hatton and Others v. the United Kingdom [GC], no. 36022/97, § 96, ECHR 2003-VIII; Kyrtatos v. Greece, no. 41666/98, § 52, ECHR 2003-VI; and Fadeyeva v. Russia, no. 55723/00, § 68, ECHR 2005-IV). - EGMR, 25.11.2010 - 43449/02
MILEVA AND OTHERS v. BULGARIA
Nor is the Court persuaded that the nuisances coming from the electronic games club were sufficient to engage Article 8. The fact of works being carried out in a neighbouring flat cannot be regarded, on its own, as a disturbance exceeding the normal hazards inherent to life in a modern town (see, mutatis mutandis, Trouche, cited above, as well as Kyrtatos v. Greece, no. 41666/98, § 54, ECHR 2003-VI (extracts)). - EGMR, 02.12.2010 - 12853/03
IVAN ATANASOV v. BULGARIA
However, Article 8 is not engaged every time environmental deterioration occurs: no right to nature preservation is included as such among the rights and freedoms guaranteed by the Convention or its Protocols (see Kyrtatos v. Greece, no. 41666/98, § 52, ECHR 2003-VI; Hatton and Others v. the United Kingdom [GC], no. 36022/97, § 96 in limine, ECHR 2003-VIII; and Fadeyeva v. Russia, no. 55723/00, § 68, ECHR 2005-IV). - EGMR, 03.07.2012 - 61654/08
MARTÍNEZ MARTÍNEZ ET PINO MANZANO c. ESPAGNE
Grèce, no 41666/98, § 52, CEDH 2003-VI (extraits)). - EGMR, 10.03.2009 - 18257/04
