(extracts) (currently pending before the Grand Chamber), the Government contended that the consistent jurisprudence of the Court, in application of Gerger, was that differences of treatment based on different laws providing for criminal penalties and procedures, being necessarily impersonal, fell outside the scope of Article 14 (see, for example, Budak and Others v. Turkey (dec.), no. 57345/00, 7 September 2004; and Yılmaz and Barım v. Turkey (dec.), no. 47874/99, 26 May 2005).
