IMMOBILIARE SAFFI v. ITALY
Auszug aus EGMR, 22.06.2010 - 14447/06
In this regard, it is also relevant that from October 2000, the applicants could have taken steps to seek to resolve their situation and were not therefore deprived of any possibility of having their complaints taken into account by the relevant authorities throughout the fourteen year period (cf. Sporrong and Lönnroth, cited above, § 70; and Immobiliare Saffi v. Italy [GC], no. 22774/93, § 56, ECHR 1999-V). - EGMR, 17.07.2003 - 32190/96
LUORDO c. ITALIE
Auszug aus EGMR, 22.06.2010 - 14447/06
Accordingly, they considered that there was an important distinction between the applicants' case and the case of Luordo v. Italy, no. 32190/96, ECHR 2003-IX where the applicant was discharged from bankruptcy almost fifteen years after being declared bankrupt and was subject to many restrictions during that period.

States are dispensed from answering before an international body for their acts before they have had an opportunity to put matters right through their own legal system and those who wish to invoke the supervisory jurisdiction of the Court as concerns complaints against a State are thus obliged to use first the remedies provided by the national legal system (see, amongst many authorities, Akdivar and Others v. Turkey, 16 September 1996, § 65, Reports of Judgments and Decisions 1996-IV; and Blatchford v. the United Kingdom (dec.), no. 14447/06, 22 June 2010).
