Eckle ./. Deutschland
Auszug aus EGMR, 23.05.2023 - 16783/20
The applicant's complaint concerning the length of the criminal proceedings has not been resolved at the domestic level because the discontinuance of the proceedings was not directly connected with the length of the proceedings and cannot therefore be considered, either directly or by implication, as a recognition of a violation of Article 6 § 1 or as reparation for the damage allegedly caused to the applicant by the length of the proceedings (see, for example, Mahmut Aslan v. Turkey, no. 74507/01, § 14, 2 October 2007; Eckle v. Germany, 15 July 1982, § 94, Series A no. 51; and Byrn v. Denmark, no. 13156/87, Commission decision of 1 July 1992, Decisions and Reports 73, p. 5). - EGMR, 25.03.1999 - 25444/94
PÉLISSIER AND SASSI v. FRANCE
Auszug aus EGMR, 23.05.2023 - 16783/20
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II, and Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII). - EGMR, 27.06.2000 - 30979/96
