PÉLISSIER AND SASSI v. FRANCE
Auszug aus EGMR, 24.04.2008 - 39405/03
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II). - EGMR, 27.05.2004 - 8415/02
METAXAS c. GRECE
Auszug aus EGMR, 24.04.2008 - 39405/03
At the same time, the Court reiterates that a judgment in which it finds a breach imposes on the respondent State a legal obligation to put an end to the breach and make reparation for its consequences in such a way as to restore as far as possible the situation existing before the breach (Metaxas v. Greece, no. 8415/02, § 35, 27 May 2004 and Iatridis v. Greece (just satisfaction) [GC], no. 31107/96, § 32, ECHR 2000-XI). - EGMR, 06.09.2007 - 39265/02
FATEYEV c. UKRAINE
Auszug aus EGMR, 24.04.2008 - 39405/03
Therefore, the Court concludes that the State's outstanding obligation to enforce the judgment given in the applicant's favour is not in dispute (see Blanutsa v. Ukraine, no. 35274/03, § 39, 20 September 2007, and Fateyev v. Ukraine, no. 39265/02, § 37, 6 September 2007). - EGMR, 20.09.2007 - 35274/03
