HENTRICH v. FRANCE
Auszug aus EGMR, 24.05.2005 - 17209/02
The purpose of Article 35 is to afford the Contracting States the opportunity of preventing or putting right the violations alleged against them before those allegations are submitted to the Court (see, for example, Hentrich v. France, judgment of 22 September 1994, Series A no. 296-A, p. 18, § 33, and Remli v. France, judgment of 23 April 1996, Reports of Judgments and Decisions 1996-II, p. 571, § 33). - EGMR, 10.07.2013 - 77562/01
SAN LEONARD BAND CLUB CONTRE MALTE
Auszug aus EGMR, 24.05.2005 - 17209/02
The Court considers that it is not necessary to ascertain whether the authorities raised the objection of non-exhaustion before the Constitutional Court and whether a failure to do so might result in the Government being estopped from raising a similar objection in Strasbourg (see, mutatis mutandis, San Leonard Band Club v. Malta, no. 77562/01, § 46, CEDH 2004- IX). - EGMR, 23.11.1983 - 8919/80
VAN DER MUSSELE c. BELGIQUE
Auszug aus EGMR, 24.05.2005 - 17209/02
That opinion was confirmed by the principles laid down by the Court in the judgments of Karlheinz Schmidt and Van Der Mussele (see Karlheinz Schmidt v. Germany, judgment of 18 July 1994, Series A no. 291-B, and Van Der Mussele v. Belgium, judgment of 23 November 1983, Series A no. 70). - EGMR, 06.11.1980 - 7654/76
VAN OOSTERWIJCK c. BELGIQUE
Auszug aus EGMR, 24.05.2005 - 17209/02
However, the existence of mere doubts as to the prospects of success of a particular remedy which is not obviously futile is not a valid reason for failing to exhaust domestic remedies (see Akdivar v. Turkey, judgment of 16 September 1996, Reports 1996-IV, p. 1212, § 71; and Van Oosterwijck v. Belgium, judgment of 6 November 1980, Series A no. 40, p. 18, § 37). - EGMR, 18.07.1994 - 13580/88
KARLHEINZ SCHMIDT v. GERMANY
