Even in the most difficult of circumstances, such as the fight against terrorism or crime, the Convention prohibits in absolute terms torture or inhuman or degrading treatment or punishment, irrespective of the victim's behaviour (see, among other authorities, Labita v. Italy [GC], no. 26772/95, § 119, ECHR 2000-IV, and Saadi v. Italy [GC], no. 37201/06, § 127, ECHR 2008).

MOLOKOV v. UKRAINE
As regards the issue of exhaustion of domestic remedies, it is closely linked to the substance of the applicant's complaint concerning the alleged lack of an effective investigation and must therefore be joined to the merits of that complaint (see, for example, Starenkyy and Others v. Ukraine [Committee], no. 71848/13, § 75, 24 June 2021).
