The Court recalls that Articles 5 § 1(a) and 7 each require that the definition of an offence under national law meet the standard of "lawfulness" set by the Convention (see the Steel and Others v. the United Kingdom judgment of 23 September 1998, Reports of Judgments and Decisions 1998-VII, § 54 and the S.W. v. the United Kingdom judgment of 22 November 1995, Series A no. 335-B, § 35).
