Suisse du 22 mai 1990, série A no 178, p. 24, par. 52).Ainsi que la Cour l'a déjà relevé, ce texte tend à préciser que les États peuvent réglementer, par un système de licences, l'organisation de la radiodiffusion sur leur territoire, en particulier ses aspects techniques (arrêt Groppera Radio AG et autres précité, série A no 173, p. 24, par. 61).
