    Anfechtung der Vaterschaft des rechtlichen durch den leiblichen Vater

    Mit der Intention, bei positiver Feststellung des Bestehens einer solchen Beziehung durch das Gericht eine Anfechtung durch den leiblichen Vater auch für die Zukunft auszuschließen (vgl. BT-Drucks. aaO S. 11), geht das Gesetz zwar im Falle der Vaterschaftsanfechtung nach § 1600 Abs. 1 Nr. 2 BGB noch über die allgemeine Beschränkung der Anfechtung durch die Frist des § 1600 b BGB hinaus; auch dies erscheint jedoch im Interesse der Rechtssicherheit und des Schutzes der bestehenden sozialen Familie, das auch der Fristenregelung zugrunde liegt (vgl. Staudinger/Rauscher aaO § 1600 b Rdn. 4), sachgerecht und zumutbar (vgl. auch EGMR FamRZ 2006, 181 Rdn. 39, 44).

    Anfechtung einer Vaterschaft nach dem Recht der Republik Ghana

    Einen Verstoß gegen Art. 8 EMRK hat der EGMR (FamRZ 2006, 181; 2006, 317) im Fall eines kenntnisunabhängigen Fristbeginns für die Anfechtung angenommen, denn schützenswert erscheint auch das Interesse des Scheinvaters, die rechtliche Verbindung zum Kind bei einer angemessenen Überlegungsfrist auflösen zu können (vgl. Staudinger/Henrich [2019] Art. 20 Rn. 56).

    Dem Grundsatz der Abstammungswahrheit steht der Aspekt der Abstammungsbeständigkeit gegenüber, wonach aus Gründen der Rechtssicherheit und zur Wahrung des (familiären) Rechtsfriedens der Status eines Kindes zeitlich nicht unbeschränkt in der Schwebe bleiben soll (vgl. BVerfG FamRZ 1975, 82; 1991, 325; EGMR FamRZ 2006, 181).
