März 1999, Nikolova/Bulgarien (CE:ECHR:1999:0325JUD003119596), heißt es, dass "[Art. 5 Abs. 4 EMRK] den Haftprüfungsrichter zwar nicht verpflichtet, jedes der vom Beschwerdeführer vorgebrachten Argumente zu prüfen, doch würden die von dieser Vorschrift gebotenen Garantien bedeutungslos, wenn der Richter gestützt auf das innerstaatliche Recht und die innerstaatliche Praxis die vom Häftling geltend gemachten konkreten Tatsachen, die geeignet sind, das Vorliegen der unerlässlichen Voraussetzungen für die "Rechtmäßigkeit" der Freiheitsentziehung im Sinne der EMRK in Frage zu stellen, als unerheblich ansehen oder unberücksichtigt lassen könnte".

    Nach dem Urteil des EGMR vom 25. März 1999, Nikolova/Bulgarien (CE:ECHR:1999:0325JUD003119596, § 61), muss ein Richter, der eine Haftbeschwerde prüft, die konkreten Tatsachen berücksichtigen, auf die sich der Häftling beruft und die die Rechtmäßigkeit der Freiheitsentziehung in Frage stellen können.
