    While the Court is not bound by the Commission's findings of fact and remains free to make its own appreciation in the light of all the material before it, it is only in exceptional circumstances that it will exercise its powers in this area (see, for example, the McCann and Others v. the United Kingdom judgment of 27 September 1995, Series A no. 324, p. 50, § 169; the Aksoy v. Turkey judgment of 18 December 1996, Reports 1996-VI, p. 2272, § 38; the Aydın v. Turkey judgment of 25 September 1997, Reports 1997-VI, pp. 1888-89, § 70; and the Mentes and Others v. Turkey judgment of 28 November 1997, Reports 1997-VIII, pp. 2709-10, § 66).

    That would have come within the line of authorities established in the Ireland v. the United Kingdom (judgment of 18 January 1978, Series A no. 25) and McCann and Others v. the United Kingdom (judgment of 27 September 1995, Series A no. 324) cases (inadequate command and supervision, negligence and lack of subsequent review).

    This insistence on the protection of the individual against any abuse of power is illustrated by the fact that Article 5 § 1 circumscribes the circumstances in which individuals may be lawfully deprived of their liberty, it being stressed that these circumstances must be given a narrow interpretation having regard to the fact that they constitute exceptions to a most basic guarantee of individual freedom (see, mutatis mutandis, the Quinn v. France judgment of 22 March 1995, Series A no. 311, p. 17, § 42).
