ROCHE c. ROYAUME-UNI
Auszug aus EGMR, 25.05.2010 - 28870/05
The Court further notes that, in addition to the primarily negative undertakings contained in Article 8, as in other provisions of the Convention there may be positive obligations inherent in an effective respect for the rights guaranteed (see Roche v. the United Kingdom [GC], no. 32555/96, § 157, ECHR 2005-X). - EGMR, 05.10.2006 - 75725/01
TROCELLIER v. FRANCE
Auszug aus EGMR, 25.05.2010 - 28870/05
As to the merits, the Court points out that people's physical and psychological integrity, their involvement in the choice of medical care administered to them and their consent in this respect, as well as their access to information enabling them to assess the health risks to which they are exposed, fall within the ambit of Article 8 of the Convention (see Trocellier v. France (dec.), no. 75725/01, 5 October 2006). - EGMR, 14.04.2009 - 75173/01
SEVIM GÜNGÖR v. TURKEY
Auszug aus EGMR, 25.05.2010 - 28870/05
The Court notes in the first place that, in cases concerning medical negligence, the Turkish legal system affords the injured parties the right to bring both criminal and civil proceedings (see Sevim Güngör v. Turkey (dec.), no. 75173/01; 14 April 2009).

Abtreibungsverbot in Polen: Lebensschützer und der "Fall Agata"
The Court has previously found States to be under a positive obligation to secure to their citizens the right to effective respect for their physical and psychological integrity (see, among many other authorities, Glass v. the United Kingdom, no. 61827/00, §§ 74-83, ECHR 2004-II; Sentges v. the Netherlands (dec.), no. 27677/02, 8 July 2003; Pentiacova and Others v. Moldova (dec.), no. 14462/03, ECHR 2005-...; Carlo Dossi and others v. Italy, (dec.), no. 26053/07, 12 October 2010; Yardımcı v. Turkey, no. 25266/05, 5 January 2010 ; §§ 55-56; Gecekusu v. Turkey (dec.), no. 28870/05, 25 May 2010). - EGMR, 25.06.2019 - 54969/09
MEHMET ULUSOY ET AUTRES c. TURQUIE
Turquie (déc.), no 28870/05, 25 mai 2010, Dossi et autres c. Italie (déc.), no 26053/07, 12 octobre 2010, Vasileva c. Bulgarie, no 23796/10, § 63, 17 mars 2016, et Erdinç Kurt et autres, précité, § 51). - EGMR, 22.02.2022 - 63662/17
UZEA v. ROMANIA
Bearing in mind that both the course of events at the hospital and the decisions taken by the doctors were exposed to public scrutiny and noting that the proceedings, albeit rather lengthy, resulted in a criminal conviction - that of one of the doctors involved at the third applicant's birth, while for the other one the investigation was closed because prescription had intervened without there being any long periods of inactivity attributable to the authorities - the Court does not find any serious defects in the authorities' conduct (see, mutatis mutandis, Gecekusu v. Turkey (dec.), no. 28870/05, 25 May 2010). - EGMR, 07.02.2017 - 64677/12
CINGÖZ c. TURQUIE
La Cour rappelle à cet égard que les questions de fond liées à l'intégrité morale et physique des individus entrent dans le champ d'application de l'article 8 de la Convention (Trocellier c. France (déc.), no 75725/01, CEDH 2006-XIV, Yardimci c. Turquie, no 25266/05, 5 janvier 2010, Gecekusu c. Turquie (déc.), no 28870/05, 25 mai 2010, et Carlo Dossi et autres c. Italie (déc.), no 26053/07, 12 octobre 2010).
