Der Kläger habe daraufhin am 16. April 2007 beim Europäischen Gerichtshof für Menschenrechte Klage gegen die Türkei eingereicht (Verfahren Nr. 18684/07).In einem Schreiben des Europäischen Gerichtshofs für Menschenrechte vom 1. Juni 2010 (Bl. 22 f der Behördenakte) im Verfahren 18684/07 des Klägers Nuri Aktas werden diese Angaben bestätigt ("statement of facts").

The Court notes, in addition, that it has previously taken into account in its analysis, among other things, the fact of earlier acceptance for official registration by the domestic authorities of the forename or name in dispute (see Johansson, cited above, § 38, and Aktas and Aslaniskender v. Turkey, nos. 18684/07 and 21101/07, § 48, 25 June 2019).We have also already mentioned (see paragraph 18.d of this opinion), the passage (see paragraph 41 of the judgment) in which the majority draw from precedents (Johansson, cited above, § 38, and Aktas and Aslaniskender v. Turkey, nos. 18684/07 and 21101/07, § 48, 25 June 2019) where the Court has "taken into account in its analysis, among other things, the fact of earlier acceptance for official registration by the domestic authorities of the forename or name in dispute" the conclusion - since in the present case "the forename in question had never been registered" - that the lack of previous registrations was an additional reason to hold that the refusal to register a name (for the first time) was justified.

Turquie, nos 18684/07 et 21101/07, § 43, 25 juin 2019).Il est à noter par ailleurs que les autorités nationales n'ont apporté aucun élément de nature à expliquer pourquoi, dans le cas d'espèce, elles ont considéré que le changement sollicité se heurtait à un impératif d'ordre public (Henry Kismoun c. France, no 32265/10, § 35, Akta?Ÿ et Aslaniskender c. Turquie, nos 18684/07 et 21101/07, § 48).
