Ukraine, 4/06/2010; Ostrovar v. Moldova, 15/02/2006; Lavents v. Latvia 28/11/2003) though, taking into consideration the differences between this present case and the mentioned other Court's case-law under the aspects of: i) duration of denial (in the present case GATTO, the denial of personal conferences lasted approximately 1 year; in the other cases mentioned, the denial lasted more than 1 year up to 4 years); ii) the quality of the applicant (in the present case GATTO, the applicant is the wife of a subject in custody on remand; in the other cases mentioned, the applicant was the detainee and, thus, in the view of this Government, exposed to a greater sense of anguish with respect to the limitation of his right to family life);.

Enfin, la Cour souligne que, dans le cas où le Gouvernement ne respecterait pas les termes de sa déclaration unilatérale, la requête pourrait être réinscrite au rôle en vertu de l'article 37 § 2 de la Convention (Josipovic c. Serbie (déc.), nº 18369/07, 4 mars 2008).
