Amending Law no. 153(I)/2011, which entered into force in November 2011, removed the possibility of punishment by imprisonment for the above contraventions; however, they remained criminal offences that could be punished by a fine (section 18; see M.A. v. Cyprus, no. 41872/10, § 65, ECHR 2013 (extracts)).

En outre, elle observe qu'en l'espèce, le requérant se plaint non pas des conditions de sa détention dans une prison spécifique, mais principalement d'une incompatibilité de son état de santé avec le milieu carcéral et de l'absence de soins adéquats dans tous les endroits où il a été détenu (voir, mutatis mutandis, Haghilo c. Chypre, no 47920/12, § 148, 26 mars 2019).En outre, rappelant également (au même paragraphe 62 de l'arrêt) que le requérant se plaint d'une « incompatibilité de son état de santé avec le milieu carcéral'en général, ainsi que « de l'absence de soins adéquats dans tous les endroits où il a été détenu ", la majorité cite mutatis mutandis l'arrêt Haghilo c. Chypre, no 47920/12, § 148, 26 mars 2019, et confirme qu'« en l'absence de preuve d'un quelconque changement substantiel dans le traitement de la pathologie psychiatrique (...) dans les différents lieux ", toute la période « s'analyse en une situation continue ".

Aux yeux de la Cour, les faits de l'espèce s'analysent donc en « une situation continue'justifiant un examen de la totalité de la période de détention dont se plaint le requérant (voir Haghilo c. MONIR LOTFY v. CYPRUS
On 10 February 2013 the applicant was arrested by the police during a random identity check in the street and, the following day, detention and deportation orders were issued against him under section 14(6) of the Aliens and Immigration Law (Cap. 105, as amended) on the grounds that he was a prohibited immigrant within the meaning of section 6(1)(i), (k) and (l) of that Law (see Haghilo v. Cyprus, no. 47920/12, §§ 97 and 99, 26 March 2019, and M.A. v. Cyprus, no. 41872/10, §§ 62-63, ECHR 2013 (extracts)).
