In establishing the extent of this duty of diligence on applicants who wish to complain about the lack of an effective investigation into deaths or ill-treatment, the Court has been largely guided in recent years by the case-law on the duty of diligence imposed on applicants who complain about the disappearance of individuals in a context of international conflict or state of emergency within a country (see Varnava and Others, cited above, § 165, ECHR 2009; Yetisen and Others v. Turkey, no. 21099/06, §§ 72-85, 10 July 2012; and Er and Others, cited above, § 52), despite the differences between those two types of situation.
