Auszug aus EGMR, 27.05.2010 - 30357/05
Turning to the question of whether the interference was "necessary in a democratic society, the Court refers, firstly, to the fundamental principles underlying its judgments relating to Article 11 (see Djavit An v. Turkey, no. 20652/92, §§ 56-57, ECHR 2003-III, and Plattform "Ärzte für das Leben" v. Austria, 21 June 1988, § 32, Series A no. 139). - EGMR, 04.12.1995 - 18896/91
RIBITSCH c. AUTRICHE
Auszug aus EGMR, 27.05.2010 - 30357/05
Furthermore, where allegations are made under Articles 2 and 3 of the Convention the Court must apply a particularly thorough scrutiny (see Ribitsch v. Austria, 4 December 1995, § 32, Series A no. 336). - EGMR, 28.07.1999 - 25803/94

Auszug aus EGMR, 27.05.2010 - 30357/05
As the Court has underlined on many occasions, Article 3 enshrines one of the most fundamental values of democratic societies; it makes no provision for exceptions and no derogation from it is permissible under Article 15 § 2 (see Selmouni v. France [GC], no. 25803/94, § 95, ECHR 1999-V, and Assenov and Others v. Bulgaria, 28 October 1998, § 93, Reports 1998-VIII).

LABITA c. ITALIE
Auszug aus EGMR, 27.05.2010 - 30357/05
Such proof may, however, follow from the coexistence of sufficiently strong, clear and concordant inferences or of similar unrebutted presumptions of fact (see Labita v. Italy [GC], no. 26772/95, § 121, ECHR 2000-IV). - EGMR, 28.11.2000 - 29462/95
REHBOCK c. SLOVENIE
Auszug aus EGMR, 27.05.2010 - 30357/05
Thus, in the particular circumstances of the present case, it cannot be said that the police were called upon to react without prior preparation (see Rehbock v. Slovenia, no. 29462/95, § 72, ECHR 2000-XII). - EGMR, 20.02.2003 - 20652/92
DJAVIT AN c. TURQUIE
Auszug aus EGMR, 27.05.2010 - 30357/05
Turning to the question of whether the interference was "necessary in a democratic society, the Court refers, firstly, to the fundamental principles underlying its judgments relating to Article 11 (see Djavit An v. OYA ATAMAN c. TURQUIE
Auszug aus EGMR, 27.05.2010 - 30357/05
It is clear from this case-law that the authorities have a duty to take appropriate measures with regard to lawful demonstrations in order to ensure their peaceful conduct and the safety of all citizens (see Balçık and Others, cited above, § 46, and Oya Ataman v. Turkey, no. 74552/01, § 35, ECHR 2006-XIII).

V.C. v. SLOVAKIA
Turquie, no 30357/05, § 39, 27 mai 2010, et autres références citées). - EGMR, 13.10.2020 - 35880/14
ZAKHAROV AND VARZHABETYAN v. RUSSIA
The Court has previously found violations of Article 3 of the Convention where police officers failed to show the required degree of tolerance and restraint when dispersing peaceful gatherings (see, for example, Biçici v. Turkey, no. 30357/05, §§ 35-36, 27 May 2010).
