  • EGMR, 23.09.1982 - 7151/75

    SPORRONG ET LÖNNROTH c. SUÈDE

    Auszug aus EGMR, 27.11.2007 - 74258/01
Thirty-five members of Parliament and the Prosecutor General brought proceedings before the Constitutional Court claiming that several provisions of Act 64/1997 were contrary to the Constitution and Article 1 of Protocol No. 1. In particular, the members of Parliament relied on the Court's case-law (James and Others v. the United Kingdom, judgment of 21 February 1986, Series A no. 98, § 54, and Sporrong and Lönnroth v. Sweden, judgment of 23 September 1982, Series A no. 52, §§ 69 and 73), arguing that there existed no genuine public interest in the interference with the landowners' rights and that the compensation which the landowners were to receive under the relevant provisions of Act 64/1997 was not appropriate.

    LINDHEIM AND OTHERS v. NORWAY

The Court found the deprivation rule applicable in James and Others (cited above, 38) and in Urbárska Obec Trencianske Biskupice v. Slovakia (no. 74258/01, § 116, ECHR 2007-... (extracts) - in so far as transfer of ownership of the applicants" plots of land was concerned).
  • EGMR, 09.07.2013 - 14796/11

DEGUARA CARUANA GATTO AND OTHERS v. MALTA

Legitimate objectives in the "public interest", such as those pursued in measures of economic reform or measures designed to achieve greater social justice, may call for less than reimbursement of the full market value (see Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, § 115, ECHR 2007-(extracts)).
  • EGMR, 22.11.2011 - 2226/10

FRENDO RANDON AND OTHERS v. MALTA

Legitimate objectives in the "public interest", such as those pursued in measures of economic reform or measures designed to achieve greater social justice, may call for less than reimbursement of the full market value (see Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, § 115, ECHR 2007-XIII).
  • EGMR, 13.05.2014 - 1349/12

    L.G.R. AND A.P.R. v. SLOVAKIA

However, the Court would point out that this position was taken because the respective complaints were directly concerned with the state of the law, coupled with the fact that - under its settled case-law - the Constitutional Court has no power, upon a complaint under Article 127 of the Constitution, to review the constitutionality of legislation (see, for example, Babylonová, cited above, §§ 44 and 45; Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, §§ 85-89, ECHR 2007-XIII (extracts); and Laduna v. Slovakia (dec.), no. 31827/02, 20 October 2010).
  • EGMR, 22.11.2011 - 2243/10

    CURMI v. MALTA

Legitimate objectives in the "public interest", such as those pursued in measures of economic reform or measures designed to achieve greater social justice, may call for reimbursement of less than the full market value (see Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, § 115, ECHR 2007-... (extracts)).
  • EGMR, 11.10.2011 - 57862/09

    VASSALLO v. MALTA

Legitimate objectives in the "public interest", such as those pursued in measures of economic reform or measures designed to achieve greater social justice, may call for less than reimbursement of the full market value (see Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, § 115, ECHR 2007-... (extracts)).

  • EGMR, 18.06.2009 - 35989/02

    NOVIKOV v. RUSSIA

However, in Karamitrov and Others v. Bulgaria (no. 53321/99, § 77, 10 January 2008) the Court considered with reference to Article 13 of the Convention that "when the authorities seize and hold chattels as physical evidence the possibility should exist in domestic legislation to initiate proceedings against the State and to seek compensation for any damage resulting from the authorities" failure to keep safe the said chattels in reasonably good condition" (compare Islamic Republic of Iran Shipping Lines v. Turkey, no. 40998/98, §§ 87, 96-103, ECHR 2007-...; Immobiliare Saffi v. Italy [GC], no. 22774/93, §§ 46 and 57, ECHR 1999-V; Urbárska Obec Trencianske Biskupice v. Slovakia, no. 74258/01, § 126, ECHR 2007-... (extracts), and Housing Association of War Disabled and Victims of War of Attica and Others v. Greece, no. 35859/02, § 39, 13 July 2006).
