PELLEGRIN v. FRANCE
Auszug aus EGMR, 28.02.2006 - 2015/02
The Court notes that in the present case there has been no allegation that the applicant's post entailed direct or indirect participation in the exercise of powers conferred by public law and duties designed to safeguard the general interests of the State or of other public authorities (see Pellegrin v. France [GC], no. 28541/95, § 66, ECHR 1999-VIII). - EGMR, 16.12.1999 - 24888/94
Mord an James Bulger
Auszug aus EGMR, 28.02.2006 - 2015/02
The burden of proof is on the Government claiming non-exhaustion to satisfy the Court that an effective remedy was available in theory and in practice at the relevant time; that is to say, that the remedy was accessible, capable of providing redress in respect of the applicant's complaints and offered reasonable prospects of success (see, for example, V. v. the United Kingdom [GC], no. 24888/94, § 57, ECHR 1999-IX). - EGMR, 27.06.2000 - 30979/96
FRYDLENDER c. FRANCE
Auszug aus EGMR, 28.02.2006 - 2015/02
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII).

ANDRASIK AND OTHERS v. SLOVAKIA
Auszug aus EGMR, 28.02.2006 - 2015/02
57984/00, 60237/00, 60242/00, 60679/00, 60680/00, 68563/01, 60226/00, ECHR 2002-IX). - EGMR, 19.03.1991 - 11069/84
CARDOT c. FRANCE
Auszug aus EGMR, 28.02.2006 - 2015/02
In the above circumstances and bearing in mind that the Convention is intended to guarantee rights that are not theoretical or illusory, but rights that are practical and effective (see, for example, Matthews v. the United Kingdom [GC], no. 24833/94, § 34, ECHR 1999-I), the Court finds that the remedy under Article 127 of the Constitution, as in force from 1 January 2002, did not offer the applicant reasonable prospects of success (see V., cited above, § 57) in seeking adequate and sufficient redress (see, for example, Cardot v. France, judgment of 19 March 1991, Series A no. 200, p. 19, § 36) in respect of the overall length of his proceedings. - EGMR, 16.07.1971 - 2614/65
RINGEISEN v. AUSTRIA
Auszug aus EGMR, 28.02.2006 - 2015/02
In this context the Court reiterates that it is not its role to decide in the abstract whether the applicable domestic law is compatible with the Convention or whether the domestic law has been complied with by the national authorities (see Ringeisen v. Austria, judgment of 16 July 1971, Series A no. 13, p. 40, § 97).
