    SOARE ET AUTRES c. ROUMANIE

    Auszug aus EGMR, 28.06.2016 - 30173/12
The Court reiterates, as concerns the accessibility of an investigation to the families and the existence of sufficient public scrutiny, that this aspect of the procedural obligation does not require applicants to have access to police files, or copies of all documents during an ongoing inquiry, or that they be consulted or informed about every step (see, for example, Armani Da Silva v. the United Kingdom [GC], no. 5878/08, § 236, ECHR 2016; Soare and Others v. Romania, no. 24329/02, § 174, 22 February 2011, Ramsahai and Others v. the Netherlands [GC], no. 52391/99, § 347, ECHR 2007-II, and Brecknell v. the United Kingdom, cited above § 77).

    ARMANI DA SILVA c. ROYAUME-UNI

MIKHEYEV v. RUSSIA

    Auszug aus EGMR, 28.06.2016 - 30173/12
However, in cases where the authorities may not necessarily be aware of an allegation that State agents intentionally have used lethal force, the lodging of a formal criminal complaint aimed at the prosecuting authorities of the respondent State to identify and punish the perpetrators is, in principle, considered an effective remedy, which should be used (see, inter alia, El-Masri v. the former Yugoslav Republic of Macedonia [GC], no. 39630/09, § 140, ECHR 2012; Feti Demirtas v. Turkey, no. § 82, 17 January 2012; and Mikheyev v. Russia, no. 77617/01, § 86, 26 January 2006).

    GÜRTEKIN AND OTHERS v. CYPRUS

    Auszug aus EGMR, 28.06.2016 - 30173/12
The obligation is of means only, not result (see, among others, Gürtekin and Others v. Cyprus (dec), no. 60441/13, 11 March 2014, and Avsar v. Turkey, no. 25657/94, § 394, ECHR 2001-VII (extracts)).

    SZULA v. THE UNITED KINGDOM

    Auszug aus EGMR, 28.06.2016 - 30173/12
There is no right, however, to obtain a prosecution or conviction (see, inter alia, Szula v. the United Kingdom, (dec.) no. 18727/06, 4 January 2007) and the fact that an investigation ends without concrete, or with only limited, results is not indicative of any failings as such.

HUGH JORDAN v. THE UNITED KINGDOM

    Auszug aus EGMR, 28.06.2016 - 30173/12
It is not for the authorities to prove that there has been no breach of Article 2 of the Convention (see, Hugh Jordan v. the United Kingdom, no. 24746/94, § 113, ECHR 2001-III (extracts)), but a satisfactory and plausible explanation regarding the necessity is required by the authorities (ibid., § 124).

    AVSAR c. TURQUIE

    Auszug aus EGMR, 28.06.2016 - 30173/12
The obligation is of means only, not result (see, among others, Gürtekin and Others v. Cyprus (dec), no. 60441/13, 11 March 2014, and Avsar v. Turkey, no. 25657/94, § 394, ECHR 2001-VII (extracts)).

ISSAIEVA, YOUSSOUPOVA ET BAZAÏEVA c. RUSSIE

  • EGMR, 03.10.2023 - 27753/19

    EL-ASMAR v. DENMARK

Moreover, by virtue of section 975 of the Administration of Justice Act (Retsplejeloven), when the prosecution has decided not to bring charges in a criminal case, the case can only be re-opened if at a later stage new evidence of significant weight emerges (see, among other authorities, Jørgensen and Others v. Denmark (dec.), no. 30173/12, § 36, 28 June 2016).

To the extent that the Government's objection is to be understood as arguing that the applicant, after the Regional Prosecutor's decision to discontinue the criminal proceedings, should have instituted civil proceedings under Article 63 of the Constitution in order to challenge the use of force and possibly obtain compensation, the Court reiterates that in the area of unlawful use of force by State agents - and not mere fault, omission or negligence - civil or administrative proceedings aimed solely at awarding damages, rather than ensuring the identification and punishment of those responsible, are not adequate and effective remedies capable of providing redress for complaints based on the substantive aspect of Articles 2 and 3 of the Convention (see, for example, Lopes de Sousa Fernandes v. Portugal [GC], no. 56080/13, § 135, 19 December 2017; Semache v. France, no. 36083/16, § 53, 21 June 2018; and Jørgensen and Others v. Denmark (dec.), no. 30173/12, §§ 62-64, 28 June 2016).

    KAFES c. TURQUIE

Par conséquent, elle ne peut pas prendre en considération ce recours aux fins du calcul du délai de six mois s'agissant des griefs tirés de l'article 3 de la Convention (voir, mutatis mutandis, Stig Wolch Jørgensen et autres c. Danemark (déc.), no 30173/12, §§ 55-63, 28 juin 2016).
  • EGMR, 26.02.2019 - 51181/10

    GÜZÜPEK v. TURKEY

The Court finds, therefore, that although the applicant lodged the present application within six months of the date of notification to him on 25 March 2010 of the final decision taken at the end of the compensation proceedings (see paragraph 31 above), those proceedings do not affect the running of the six-month period (see, mutatis mutandis, Alkin, cited above, § 33; see also Erkan v. Turkey (dec.), no. 41792/10, §§ 64-65, 28 January 2014, and Jørgensen and Others v. Denmark (dec.), no. 30173/12, §§ 62-63, 28 June 2016).
  • EGMR, 12.02.2019 - 57273/16

    CHAABAN ET AUTRES c. BELGIQUE

En conséquence, elle a rejeté les requêtes pour tardiveté (voir, entre autres, Jørgensen et autres c. Danemark (déc.), no 30173/12, § 63, 28 juin 2016, Narin c. Turquie, no 18907/02, § 49, 15 décembre 2009, et Bedir c. Turquie (déc.), no 25070/02, 2 octobre 2007).
  • EGMR, 29.11.2022 - 79650/16

    ARSLAN c.

Royaume-Uni [GC], no 55721/07, § 165, CEDH 2011).
  • EGMR, 15.03.2018 - 17521/09

    TEYMURAZYAN v. ARMENIA

It reiterates that in the area of unlawful use of force by State agents - and not mere fault, omission or negligence - civil or administrative proceedings aimed solely at awarding damages, rather than ensuring the identification and punishment of those responsible, are not considered adequate and effective remedies capable of providing redress for complaints based on the substantive aspect of Articles 2 and 3 of the Convention (see Mocanu and Others v. Romania [GC], nos. 10865/09 and 2 others, § 227, ECHR 2014 (extracts), and Jørgensen and Others v. Denmark (dec.), no. 30173/12, 28 June 2016).
