LÜDI v. SWITZERLAND
- EGMR, 15.07.1982 - 8130/78

BRONIOWSKI c. POLOGNE
Once such a defect has been identified, it falls to the national authorities, under the supervision of the Committee of Ministers, to take, retroactively if appropriate (see Bottazzi v. Italy [GC], no. 34884/97, § 22, ECHR 1999-V, Di Mauro v. Italy [GC], no. 34256/96, § 23, ECHR 1999-V, and the Committee of Ministers' Interim Resolution ResDH(2000)135 of 25 October 2000 (Excessive length of judicial proceedings in Italy: general measures); see also Brusco v. Italy (dec.), no. 69789/01, ECHR 2001-IX, and Giacometti and Others v. Italy (dec.), no. 34939/97, ECHR 2001-XII), the necessary remedial measures in accordance with the subsidiary character of the Convention, so that the Court does not have to repeat its finding in a lengthy series of comparable cases. - EGMR, 17.12.2004 - 33348/96
CUMPANA AND MAZARE v. ROMANIA
Questions may be asked as to this severity where a substantive right has been infringed and this generosity where there has been a procedural violation (see, in this connection, for example, the dissenting opinions in Di Mauro v. Italy [GC], no. 34256/96, ECHR 1999-V). - EGMR, 17.01.2002 - 32967/96
CALVELLI ET CIGLIO c. ITALIE
Despite the defects of the Italian judicial system, which it is to be hoped the recent Pinto law will help to remedy domestically, personally I have always been opposed to resorting to a sort of presumption of a violation of Article 6 that would lead to complaints of this type being upheld "automatically" (I refer on this subject to my dissenting opinion annexed to Di Mauro v. Italy [GC], no. 34256/96, ECHR 1999-V).

DRIZA c. ALBANIE
Furthermore, once a deficiency in the legal system has been identified by the Court, the national authorities have the task, subject to supervision by the Committee of Ministers, of taking within a determined period of time - retrospectively if needs be - (see, among other authorities, Xenides-Arestis v. Turkey, no. 46347/99, §§ 39, 40, 22 December 2005; Scordino v. Italy (no. 1) [GC], no. 36813/97, § 233, ECHR 2006; Broniowski v. Poland [GC], no. 31443/96, § 192, ECHR 2004-V; Bottazzi v. Italy [GC], no. 34884/97, § 22, ECHR 1999-V; and Di Mauro v. Italy [GC], no. 34256/96, § 23, ECHR 1999-V) the necessary measures of redress in accordance with the principle of subsidiarity under the Convention, so that the Court does not have to reiterate its finding of a violation in a long series of comparable cases. - EGMR, 06.09.2001 - 69789/01
BRUSCO v. ITALY
Italie [GC], no 34884/97, § 22, CEDH 1999-V, et Di Mauro c. Italie [GC], no 34256/96, § 23, CEDH 1999-V). - EGMR, 13.11.2007 - 38222/02
RAMADHI AND OTHERS v. ALBANIA
Subject to supervision by the Committee of Ministers, the national authorities have the task of taking - retrospectively if needs be - (see among other authorities Scordino v. Italy (no. 1) [GC], no. 36813/97, § 233, ECHR 2006 and Broniowski v. Poland [GC], no. 31443/96, § 192, ECHR 2004-V; Bottazzi v. Italy [GC], no. 34884/97, § 22, ECHR 1999-V, Di Mauro v. Italy [GC], no. 34256/96, § 23, ECHR 1999-V) the necessary measures of redress in accordance with the principle of subsidiarity under the Convention, so that the Court does not have to reiterate its finding of a violation in a long series of comparable cases. - EGMR, 29.03.2006 - 65102/01
