Auszug aus EGMR, 28.10.2010 - 52502/07
However, the Court observes that the impugned statements formed part of the Supreme Court's reasoning leading to its conclusion in the adoption case (compare Sanchez Cardenas v. Norway, no. 12148/03, § 37, 4 October 2007); they reflected the objective fact that the parents had been suspected of the ill-treatment in question but did not amount to an affirmation of criminal guilt falling within Article 6 § 2 of the Convention (see Lutz v. Germany, 25 August 1987, § 62, Series A no. 123; Englert v. Germany, 25 August 1987, § 38, Series A no. 123; Nölkenbockhoff v. Germany, 25 August 1987, § 39, Series A no. 123; and compare Minelli v. Switzerland, 25 March 1983, § 38, Series A no. 62).

S.H. c. ITALIE
- EGMR, 31.05.2011 - 35348/06
R. AND H. v. THE UNITED KINGDOM
For these reasons, measures which deprive biological parents of the parental responsibilities and authorise adoption should only be applied in exceptional circumstances and can only be justified if they are motivated by an overriding requirement pertaining to the child's best interests (see Aune v. Norway, no. 52502/07, § 66, 28 October 2010; Johansen, cited above, § 78 and, mutatis mutandis, P., C. and S. v. the United Kingdom, no. 56547/00, § 118, ECHR 2002-VI). - EGMR, 19.05.2022 - 21574/16
ROENGKASETTAKORN ERIKSSON v. SWEDEN
In the Court's assessment, the reasons advanced by the Court of Appeal were relevant for its decision, according to the Court's case-law (see, for instance, Johansen v. Norway (dec.), no. 12750/02, 10 October 2002, and Aune v. Norway, no. 52502/07, §§ 76-78, 28 October 2010, which both concerned the more far-reaching measure of adoption). - EGMR, 10.06.2021 - 54419/19
S.P. v. NORWAY
The Court has held that where social ties between a parent and his or her children have been very limited, "[t]his must have implications for the degree of protection that ought to be afforded to [the parent's] right to respect for family life under paragraph 1 of Article 8 when assessing the necessity of the interference under paragraph 2" (see, for example, Mohamed Hasan v. Norway, no. 27496/15, § 161, 26 April 2018; Aune v. Norway, no. 52502/07, § 69, 28 October 2010; and, mutatis mutandis, P., C. and S. v. the United Kingdom, no. 56547/00, § 118, ECHR 2002-VI and R. and H. v. the United Kingdom, no. 35348/06, § 88, 31 May 2011).
